APPLE TREE DEED
1782 - 1837
Here are two documents that appear to be part of a bundle that probably relate to the same property, note the old reference numbers which suggest a series of documents. The first dated 1782 (ref: 147202 1/2) and the second dated 1835 (ref: 147205 1/2). These were copied in the Worcestershire Record Office some years ago. The first is clearly concerned with the Canning family, while the second relates to a tenement involving Messeurs Marshall and Carless. Unfortunately the property or properties have not been identified. On the deeds of Crooked Walls, however, the name 'Careless' is written on the adjacent lane. Another pointer is a messuage identified as the Steps against which 'Careless' is recorded in the deeds of the Grange/Bank House.

This Indenture made the twenty fifth day of November in the first year of the reign of her present Majesty queen Victoria and in the year of our Lord One thousand eight hundred and
thirty seven Between the Right Reverend and Worshipful George Lord Bishop of Rochester Dean of the Cathedral Church of Christ and the Blessed Mary the Virgin
of Worcester and the Chapter of the same Church of the one part and John Marshall of Harvington in the County of Worchester Gentleman and John Careless
of North Littleton in the same County Farmer (Assignees of Robert Harris of the Borough of Evesham in the County of Worcester Yeoman) of the other part Whereas
an Indenture of Lease bearing date the twenty sixth day of November One thousand eight hundred and twenty one the then Dean and Chapter of the said Cathedral Church
did for themselves and their successors demise grant act and to farm let unto the said Robert Harris the premises hereinafter mentioned and described for and during the natural lives of William Canning then aged about Fifty five years son of Anna
Canning then late of the parish of Harvington in the County of Worcester Widow deceased Sarah Carless of the parish of Harvington aforesaid Widow then aged about Forty years and of Joshua Carless then aged about Eighteen years son of the said Sarah
Carless and for and during the natural life of the longest lives of them And whereas the said William Canning (one of the said lives) is lately deceased And whereas the said John Marshall and John Careless have
surrendered and yielded up into the hands of the said Dean and Chapter the said Indenture of Lease of the twenty sixth day of November One thousand eight hundred and twenty one and all the premises therein comprised in order that a new life may
be added in the premises in the place of the said William Canning deceased Now this Indenture Witnesseth that the said Dean and Chapter of the said Cathedral Church for and in consideration of the said recited surrender
and for divers other good reasons and considerations the said Dean and Chapter hereunto here serving have with one full and whole assent and consent demised granted set and to farm let and by these presents for themselves and their successors Do
demise grant set and to farm let unto the said John Marshall and John Carless All that cottage or tenement and piece of Waste Ground in Harvington aforesaid called or known by the name of Sudbury hereafter described as having a smiths
shop therein and in that thereunto adjoining extending in length by the Cemetery of the church of Harvington aforesaid unto Thomas Cleve formerly in the tenure of Henry Perkes and Richard Haines since of Thomas Marshall and now of the said [John Careless]
(except and along [-----?] out of this Demise and Grant and the said Dean and Chapter and their successors all Timber Trees now growing or standing or which shall hereafter stand or grow upon the said demised premises with free liberty to fell cut
down and carry away the same at their will and pleasure To have and to hold the said cottage or tenement close and premises with their and every of their appurtenances (except as before accepted) unto the said John Marshall and
John Carless their heirs and assigns for and during the natural lives of the said Sarah Carless of the parish of Harvington aforesaid Widow aged about Fifty six years the said Joshua Careless aged about Thirty (four years the said? [- written above]) and of John Careless of North Littleton
Yeoman one of the parties hereto aged about thirty years and for and during the natural life of the longest liver of them But In trust nevertheless for Sarah Carless of Harvington Widow her heirs and assigns Yielding and Paying therefore yearly during
the said Term unto the said Dean and Chapter and their successors at home in the said Cathedral Church or the precinct of the same to the hands of them General Receiver there for the time being or to his Deputy Three shillings of lawful
money of Great Britain at his usual terms or feasts in the year (that is to say) the feasts of the Administration of the Blessed Virgin Mary and Saint Michael the Archangel by even and equell portion And also yielding doing and
performing suit and service at all and every the court and thereof the said Dean and Chapter and their successors hereafter to be holden for their Manor of Harvington aforesaid there to take or hath
enquire and make presentments with the Homage and Jurors the Court of the said Dean and Chapter in such sort and manner as the tenants of the said Manor do or if Right ought to do And the said John Marshall and John
Careless for themselves their heirs and assigns do covenant promise and agree to and with the said Dean and Chapter and their successors that they the said John Marshall and John Careless their heirs and assigns shall and will well and
truly pay or cause to be paid the said yearly rent of three shillings during the said Term at the days and times hereinafter appointed for payment thereof according to the true extent and meaning of their presents And that they
the said John Marshall and John Carelass their heirs and assigns shall and will during the Term hereby granted well and suffiently maintain repair sustain uphold and keep and if need be now build and make all the Houses Edifaces
and Buildings hereby demised and the Mounds and Inclosures of the said premises at their own proper costs and charges and the same as well and sufficiently repaired maintain repair sustain uphold and kept at and to the end of the said
term shall and will peacefully and quietly leave and yield up to the said Dean and Chapter and their successors And also shall and will bear pay and discharge all taxations impositions payments and burdens whatsoever as
well ordinary or extraordinary incident unto or which shall be rated assessed or impared upon the said demised premises or the rent hereby received or payable out of or for the same during all the Term aforesaid and therefrom safe
harmless and keep indemnified the said Dean and Chapter and their successors And also shall and will at all or any time for times hereafter during the said Term hereby demise produce and shew forth unto the said
Dean and Chapter and their successors the several persons hereinbefore named for where lives the premises are held within the space of six weeks next after the same shall be demanded or required by the said Dean and Chapter
or their successors if the said persons shall be then living and shall and will make known and certify unto the said Dean and Chapter and their successors the death of any of the said persons at or before the next General Chapter
meeting to be held by the said Dean and Chapter and their successors or Court to be holden within the Manor of Harvington aforesaid of the death of such person And the said Dean and Chapter do hereby make
constitute and appoint John Hall Clifton of the City of Worcester[?] Gentleman and Thomas Gould Marshall of Harvington aforesaid Farmer their new and lawful attornies jointly and severally for them and in their names into and upon the
said demised premises to enter and thereof to take possession and seizin and after such possession and seizin so had and taken the same again to give and deliver unto the said John Marshall and John Careless together
lawful Atterney To hold to them the said John Marshall and John Careless their heirs and assigns according to the true intent and meaning of these presents And the said Dean and Chapter do hereby ratify allow and
confirm all and whatsoever their said attornies or either of them shall lawfully do im the premises In Witness whereof to the one part of this Indenture remaining with the said John Marshall and John Careless
the said Dean and Chapter their Commen Seal and to the other part thereof remaining with the said Dean and Chapter the said John Marshall and John Careless their hands and seals inter changeably
set the day and year first above written.

Lord One thousand seven hundred and Eighty two Between the Reverend and Worshipful Robert Foley Doctor in Divinity Dean of the Cathedral Church of Christ and the blessed Mary the
Virgin of Worcester and the Chapter of the same church of the one part and John Caning of Harvington in the County of Worcester Carpenter and Anna his wife which said Anna
Caning is the Daughter Heir at law of John Caning late of Harvington aforesaid deceased of the other partWitnesseth that the said Dean and Chapter for and
in consideration that the said John Caning and Anna his Wife have surrendered and yielded up and do hereby surrender and yield up into the hands of the said Dean and
Chapter all their Estate right title term and Interest of in and to the premises with the appurtenances hereinafter described and demised together with one Indenture of Lease
thereof bearing date the three and seventeenth day of June One thousand seven hundred and forty six granted and made by the then Reverend Chapter of the said Cathedral Church
to the said John Caning deceased and for divers other good causes and considerations them the said present Dean and Chapter hereunto now moving Have with
One full and whole assent and consent demised granted set and to farm let and by these presents for the members and their successors Do demise grant set and to farm let
unto the said John Caning and Anna his wife All that Cottage or Tenenment and piece of Waste ground in Harvington aforesaid called or known by the name of
Sudbury (heretofore described as having a Smiths Shop thereon) and one Close thereunto to adjoining extending in length by the Cemetery of the Church of Harvington To have
and to hold
the said Cottage or Tenement Close and premises with their and every of their appurtenances unto the said John Caning and Anna his wife his
heirs and assigns for and during the natural lifes of the said Anna Caning aged about Forty Nine years the said John Caning aged about Forty eight years and of
William Caning aged about seventeen Years Son of the said John and Anna Caning parties hereto and for and during the natural life of the longest liver of them
Yielding and paying therefore yearly during the said term unto the said Dean and Chapter and their successors at home in the said Cathedral Church or the Precincts
of the same to the hands of their General Receiver there for the time being or to his Deputy three shillings of lawful Money of Great Britain at two usual terms or feasts in
the year that is to say the feast of the annunciation of the blessed Virgin Mary and Saint Michael the archangel by even andequal portions And also yielding
doing and performing suit and service at all and every the Court and Courts of the said Dean and Chapter and their successors hereafter to be holden for their Manor of
Harvington aforesaid there to take an Oath enquire and make Presentment with the Homage and Jurors at the said Court in such sort and mannere as other the Tenants of
the said Manor do or of right ought to do And the said John Caning doth hereby for himself and for the said Anna his Wife and for their Heirs and assigns covenant
promise and agree to and with the said Dean & Chapter and their successors that they the said John Caning and Anna his wife their heirs and assigns or some or one of them
shall and will during the term hereby granted well and sufficiently maintain repair sustain uphold and keep and if need be new build and make all the Houses Edifaces
and buildings in and upon the said demised premises and the Mounds and Inclosures of the same and every of them at his her and their or some or one of their own proper costs
and charges and the same so well and sufficiently repaired maintained sustained upheld and kept at and in the end of the said term shall and will peaceably and quietly
leave and yield up to the said Dean and Chapter and their successors And also shall and will pay bear and discharge all Taxations Impositions payments and burdens
whatsoever as well ordinary as extraordinary incident unto or which shall be rated assessed or improved upon the said demised premises or the Rent hereby recieved or
payable out of or for the same during all the term aforesaid and there from save harmless and keep indemnified the said Dean and Chapter and their successors
And shall not nor will not alien demise grant assign or set over the said demised premises or any part thereof to any person or persons whatsoever without the
special license and consent of the said Dean and Chapter of the said Cathedral Church for the time being first had and obtained in writing under their Common Seal And
also shall and will at all or any time or times hereafter during the term hereby demised produce and shew forth unto the said Dean and Chapter and their successors the
several persons hereinbefore named for whose lives the premises are held within the space of Eight weeks next after the same shall be demanded or required by the said Dean and
Chapter or their successors if the said persons shall then be living and shall and will make known and certify unto the said Dean and Chapter or their successors the death
of any of the said persons at or before the next General Chapter or meeting to be held by the said Dean and Chapter or their successors or Court to be holden within the Manor of
Harvington aforesaid after the death of such person And if it shall happen that the said yearly Rent of three shillings shall be behind and unpaid in part or in all by the
space of twenty eight days next after either of the said feast days on which the same ought to be paid or aforesaid that then and from the neeforth it shall and may be lawful to
and for the said Dean and Chapters and their successors assigns and Officers into the said demised premises with its appurts to reenter and the same to have again repossess
and enjoy as in their former Estate any thing herein contained to the contrary the thereby in any wise notwithstanding And the said Dean and Chapter do hereby make
constitute and appoint Thomas Walford Marshall Bayliff of the Manor of Harvington and Joseph Harris Yeoman their true and lawful Attornies jointly and severally
for them and in their names into and upon the said demised premises to enter and thereof to take possession and seizin and after such possession and seizin so and taken
the same again to give and deliver unto the said John Caning or to his lawful Attorney To hold to the said John Caning and Anna his wife their heirs and assigns according
to the true intent and meaning of these presents And the said Dean and Chapter do hereby ratify allow and confirm all and whatsoever their said Attorneys or either of them shall
lawfully do in the premises In Witness whereof to the one part of this Indenture remaining with the said John Caning and Anna his wife the said Dean and Chapter
their Common seal and to the other part thereof remaining with the said Dean and Chapter the said John Caning his hand and seal interchangeably have put the day and year
first above written.

again did give & deliver unto the within named John Caning & Anna his wife to hath to them his
Heirs & Assigns according to the true intent & meaning of the within written Indenture
