This Indenture made the twenty fourth day of May One thousand eight hundred and forty four Between George Ebenezer Knight of Bilston in the County of Stafford Gardener and Seedsman of the one part and Winifred Maria Fisher of / Childswickham in the County of Gloucester Spinster of the other part Whereas at a Court Baron of the Reverend the / Dean and Chaptor of the Cathedral Church of Christ and the blessed Mary the Virgin of Worcester held in and for the Manor / of Harvington in the County of Worcester the fourteenth day of October in the year One thousand eight hundred and eighteen / one Messuage and half yard Land with the Appurtenances were by the Lords of the said Manor by their Steward granted to Samuel Stone Charles aged about thirty five / years and to Edmund Charles aged about thirty two years In trust for Mary Sheaf of Dorsington in the County of Gloucester Spinster Purchaser of the Premises and to surrender / when by her her Executors administrators or assigns required To hold unto the said Samuel Stone Charles and Edmund Charles Upon Trust as aforesaid for the term of their lives / and the life of the longer liver of them successively according to the Custom of the said Manor under and subject to a yearly rent and to a Heriot when it should happen Suit of / Court Customs and Services therefore due and of right accustomed and to the payment of all taxes and the said Samuel Stone Charles was admitted Tenant And whereas / at the same Court the Lords by the Stewards aforesaid granted to Henry Sheaf aged about twenty two years and Charles Sheaf aged about twenty years therein respectively / described named In trust for the said Mary Sheaf and to surrender when by her her executors administrators or assigns required The reversion of the said Messuage and / half yard Land with the Appurtenances therein the tenure of the said Samuel Stone Charles To hold unto the said Henry Sheaf and Charles Sheaf Upon trust as aforesaid / for the term of their lives and the longer liver of them successfully according to the Custom of the said Manor separately after the decease surrender or forfeiture of the said / Samuel Stone Charles and Edmund Charles under and subject to the yearly rent or heriot when it should happen suit of Court and other Customs and services therefore due and / of right accustomed and to the payment of all taxes And whereas by an Agreement dated on or about the sixteenth day of July One thousand eight hundred and / thirty and made between the said Mary Sheaf of the one part and Mary Badderley of Harvington aforesaid Spinster of the other part Reciting the hereinbefore recited Grants / in trust for the said Mary Sheaf It was witnessed that in Consideration of the Sum of Sixty pounds for the purchase of the piece of Land thereinafter described the said Mary / Sheaf did for herself her heirs executors and administrators covenant and agree with the said Mary Badderley her executors and administrators that she the said Mary / Sheaf her executors or administrators would at any time thereafter at the Costs of the said Mary Badderley her heirs executors administrators or assigns convey or procure to be conveyed / unto the said Mary Badderley her executors administrators or assigns or as she or they should direct All that piece or parcel of Land containing together Two thousand / four hundred and twenty square yards or thereabouts situate and being within and parcel of the Manor of Harvington aforesaid and part and parcel of the half yard / land thereinbefore particularly mentioned and described and comprised in the several grants therein and hereinafter recited and which were described as then being in the / tenure of the said George Ebenezer Knight under a certain Lease therein mentioned and which said piece or parcel of land was therein described to be bounded Southward by / the Public road or street Eastwards by part of the Glebe belonging to the benefic of Harvington and on all other sides thereof by part of the remainder of the premises / comprised in the said recited Grants together with all the Appurtenances thereto together with the apportioned rent for the same of Two pounds during the continuance of the said / Lease To hold unto the said Mary Badderley her executors administrators and assigns during the lives of the said Samuel Stone Charles and Edmund Charles / and the life of the longer liver of them and after the decease surrender or forfeiture of the said Samuel Stone Charles and Edmund Charles during the life of the said / Henry Sheaf and Charles Sheaf and the longer liver of them successively subject to such Conditions so far as the same are applicable to the said piece of Land thereby / agreed to be sold as the said Mary Sheaf then held the same and to the apportioned rent of Two pounds And the said Agreement contained Covenants on the part of / the said Mary Sheaf upon the decease of the said Cestuis qui vie or either or any of them or upon the surrender or forfeiture by them any or either of them of the / Estate or Estates respectively granted by the said Grants to use her atmost endeavours to procure from the Lords of the said Manor for the time being a fresh Grant / of the said half yard Land and Premises for some other life or lives according to the Custom of the said Manor in trust for her the said Mary Sheaf her executors / administrators or assigns and so from time to time respectively as any of the persons for whose life or lives the half yard Land and premises should be / thereafter granted as aforesaid should stop off or determine to endeavour procure a fresh grant or grants thereof for some other life or lives in trust as aforesaid / according to the Custom of the said Manor so that as far as might be the same might be always held In trust as aforesaid for two subsisting lives in possession / and now in reversion And also on every such death renewal or regrant to pay or cause to be paid the Heriot or Heriots ffees ffines and expences payable in / respect thereof and not knowingly to permit or suffer to be done any act or deed whatsoever whereby or by reason or means whereof the said half yard Land and premises / any part thereof should or might be incumbered forfeited or surrendered except to the intent and purpose of taking or procuring a regrant thereof And further upon every / fresh Grant to her or them or to her or their nominee or nominees of the said Messuage and half yard Land or any part thereof at the Costs and charges of the said / Mary Badderley her executors administrators or assigns to assign or convey or cause to be assigned or conveyed to the said Mary Badderley her executors administrators and / assigns the said piece or parcel of Land thereby agreed to be sold on payment by her or them of such proportion of the value of the Heriot or Heriots to be rendered or paid for the / same Premises and of the fees fines and expences which should have been paid by the said Mary Sheaf her executors administrators or assigns upon every such renewal or / fresh grant as two indifferent persons from time to time one to be chosen by the said Mary Sheaf her executors administrators or assigns and the other by the said Mary / Badderley her excutors administrators or assigns (or their Umpire) should fix and adjudge to be paid by the said Mary Badderley her executors administrators or / assigns in respect of the piece of Land thereby agreed to the sold And whereas a messuage and Outbuildings and two cottages are now standing on part of the said / Land comprised in the said Agreement and such piece of Land is to be the piece of Land hereinafter distinguished as the piece of Land late belonging to the said Mary Badderley

Memorandum - The Sum insured by the within mentioned
Policies of Insurance granted by the Hand in hand Fire
and Life Insurance Society were duly paid on the 31st May
1876 to Mr Anthony Martin the Assignee.

And whereas the said Mary Badderley duly made and published her last Will and Testament in writing dated on or / about the twenty eighth day of ffebruary one thousand eight hundred and thirty two and she thereby gave / and devised All the said piece or part of Land late belonging to the said Mary Badderley and in / the said Will mentioned as containing together Two thousand four hundred and twenty square yards or / thereabouts and lately purchased by her of Mary Sheaf and Messuages or Tenaments Cottages and other erections and Buildings thereon unto John Oldaker / of Abbots Salford in the County of Warwick Maltster and John Edwards of the same place Maltster their executors administrators and assigns for the Estate or interest / which she should have therein at the time of her decease Upon trust to pay the rents heriots fees fines and expences which from time to time aught to be paid and / rendered on the parts of the grantees thereof And upon further trust from time to time to promise renewals of the subsisting grants of the said Premises upon / reasonable terms and out of the rents and profits of the said Land and premises in the meantime or by Mortgage thereof or any part thereof to levy and raise / such sum or sums of money as should be sufficient to effect the renewal of any of the subsisting Leases of the said premises when and as often as a renewal / should be advisable or necessary and to apply the sum or sums to be so raised in effecting such renewal or renewals accordingly and subject to the trusts thereinbefore / declared Upon trust during the natural lives of the said George Ebenezer Knight in the said Will called George Ebenezer Knight the Elder and Hannah his wife / and the life of the Surviver of them in case her Niece Isabella Knight should so long live and immediately upon and after she the said Isabella Knight should / have attained the age of twenty one years out of the said rents and profits pay an Annuity or yearly Sum of Ten pounds free from deductions for the benefit of the / said Isabella Knight as therein mentioned and as to the residue of the said rents and profits and in the meantime and until the said Isabella Knight should / attain the said age of twenty one years as to the whole of the said rents and profits Upon trust to pay the same to the said George Ebenezer Knight during the / Term of his natural life for his own proper use and benefit And the said Testerix appointed the said John Oldaker and John Edwards Executors of her said Will / And Whereas the said Mary Badderley thereby afterwards departed this life without having altered or revoked her said Will and the same was on / about the fifteenth day of August one thousand eight hundred and thirty seven duly proved by the said Executors thereof in the Prerogative Court of the Archbishop of Canterbury / and the said Executors have duly assured to the said bequest And Whereas by an Agreement dated the tenth day of April one thousand eight / hundred and forty one and made between the said Mary Sheaf of the one part and the said George Ebenezer Knight of the other part after reciting the / hereinbefore recited Grants It was witnessed that in Consideration of the Sum of Thirty pounds and ten shillings Sterling for the purchase of the piece of Land / thereinafter described She the said Mary Sheaf for herself her heirs executors and administrators did thereby Covenant and agree with the said George Ebenezer Knight his / executors and administrators that she the said Mary Sheaf her executors or administrators would at any time thereafter at the request and Costs of the said George / Ebenezer Knight his heirs executors administrators or assigned convey and assure or cause to be converted unto the said George Ebenezer Knight his executors / administrators or assigns or as he or they should direct All that piece or parcel of Land containing together Six hundred and ten square yards or thereabouts / situated and being within and parcel of the Manor of Harvington aforesaid and part and parcel of the half yard Land therein and hereinbefore particularly / mentioned and described and comprised in the several Grants therein and hereinbefore recited and which was late in the tenure of the said George Ebenezer Knight / under and by virtue of the previously mentioned Lease then abandoned and the same Land was then in the occupation of Richard Squires which said piece or / parcel of Land thereby contracted to be sold was therein described to be bounded Southward by the Public road or street Eastwards by part of the Glebe belonging to the / Beneface of Harvington aforesaid on the North side thereof by Land late belonging to Mary Badderley but then to the said George Ebenezer Knight and the West / side thereof by Land still remaining the property of the said Mary Sheaf together with all appurtenances to the said piece or parcel of Land belonging or appertaining / To hold unto the said George Ebenezer Knight his executors administrators and assigns thenceforth during the term of the lives of the said Samuel Stone Charles and / Edmund Charles and the life of the longer liver of them and after the decease surrender or forfeiture of the said Samuel Stone Charles and Edmund Charles during / the lives of the said Mary Sheaf and Charles Sheaf and the longer liver of them successfully in such manner and subject to Conditions as far as the same were / applicable to the said piece of Land thereby agreed to be sold as the said Mary Sheaf then held the same and under the yearly apportioned rent of one shilling / reserved by the aforesaid Grants during all the time and terms aforesaid free from all incumbrances whatsoever created or occasioned by the said Mary Sheaf / And the said Agreement contained a Covenant on the part of the said Mary Sheaf with the said George Ebenezer Knight his executors and administrators to / endeavour to procure fresh Grants of the said half yard Land and Premises on the stopping of any of the lives and to pay the Heriots and ffines in respect thereof and / not knowingly to permit or suffer any act whereby the said half yard Land and premises might be incumbered foreited or surrendered except for the purpose of taking / a regrant precisly corresponding with the hereinbefore recited Covenants entered into by the said Mary Sheaf with the said Mary Badderley and also to / Covenant upon every fresh grant to convey the premises comprised in the now reciting Agreement to the said George Ebenezer Knight upon similar terms to those / mentioned in the hereinbefore recited Agreement with the said Mary Badderely And Whereas by a Policy of Assurance dated the twenty ninth day of April last past

This Indenture made the nineteenth day of November in the year of our Lord one thousand eight hundred and forty nine Between Howard William Mansfield Jackson of Hampstead in the County of Middlesex Gentleman and Winifred Maria his wife (in the within / written Indenture called Winifred Maria Fisher Spinster) of the first part the within named George Ebenezer Knight hereinafter called / George Ebenezer Knight the elder of the second part and George Ebenezer Knight the younger of Wolverhampton in the County of Stafford Seedsman of the third part Whereas on the twenty / seventh day of June last the within mentioned Winifred Maria Fisher intermarried with and became the wife of the said Howard William Mansfield Jackson And whereas default was made by the said / George Ebenezer Knight the elder in payment of the principal sum of One hundred and fifty pounds secured by the within written Indenture And whereas on the seventeenth day of February in the year one / thousand eight hundred and forty seven such principal sum together with an arrear of interest was due and owing to the said Winifred Maria Jackson and the said Winifred Maria Jackson on / the said seventeenth day of February one thousand eight hundred and forty seven duly caused to be served on the said George Ebenezer Knight the Elder a Notice in conformity with the terms of the / power of Sale within contained and at the expiation of the Calender month from such notice the sum due for principal and interest on the within security was not paid and the sum hath not / since been paid and the said principal sum of One hundred and fifty pounds together with an arrear of interest thereon and certain annual premiums on the within mentioned Policy of Assurance / amounting in the whole on a balance of account to the sum of One hundred and ninety Pounds now remains due and owing to the said Howard William Mansfield Jackson and Winifred Maria / his wife under or by virtue of the within written Indenture And whereas the said George Ebenezer Knight the younger hath contracted and agreed with the said Howard William Mansfield Jackson / and Winifred Maria his wife for the absolute purchase of the Hereditaments Policy and Premises granted assigned or otherwise assured by the within written Indenture at or for the price or sum of One / hundred and ninety Pounds And the said George Ebenezer Knight the elder hath agreed to concur in and execute these presents Now this Indenture witnesseth that in / consideration of the sum of One hundred and ninety Pounds of lawful money of Great Britain by the said George Ebenezer Knight the younger to the said Howard William Mansfield Jackson and / Winifred Maria his wife in hand paid the receipt whereof and that the same is in full satisfaction of all money owing upon the within written Security they the said Howard William Mansfield Jackson and / Winifred Maria his wife do hereby severally acknowledge and from the same acquit and discharge the said George Ebenezer Knight the younger and also the said George Ebenezer Knight the elder They / the said Howard William Mansfield Jackson and Winifred Maria his wife with the consent and approbation of the said George Ebenezer Knight the elder testified by his executing these presents Do / hereby grant bargain sell assign transfer and set over And the said George Ebenezer Knight the elder Doth hereby grant bargain sell assign release and and confirm unto the said George Ebenezer / Knight the younger his executors administrators and assigns All and singular the piece of Land late belonging to the within named Mary Badderley And all other the Hereditaments / and Premises conprised in the first within receipted Agreement and the Messuages Cottages and Buildings thereon And also all and singular the Piece of Land Hereditaments and / Premises in the within written Indenture described and comprised in the within mentioned Agreement of the tenth day of April one thousand eight hundred and forty one with the appertenances to the / said several Indentures belonging And also the said Agreement of the said tenth day of April one thousand eight hundred and forty one and all the Covenants therein mentioned And all benefit and / advantage to be derived therefrom And all sum and sums of money to become payable in respect thereof Ann also all the within mentioned Instrument or Policy of Assurance leaving date on or about the twenty / ninth day of April one thousand eight hundred and forty four whereby the life of the said George Ebenezer Knight the elder is Assured as within mentioned And all and every sums and sum of money to become / payable by virtue thereof And all benefit and advantage to be had or derived therefrom And all the right title interest property use trust equity of Redemption claim and demand whatsoever of the said Howard / William Mansfield Jackson and Winifred his wife and George Ebenezer Knight the elder and each and every of them in respect of the said several Hereditaments and Premises Agreement and Covenants and Policy / and other the Premises hereinbefore assigned under or by virtue of the within written Indenture To have and to hold the said Piece of Land late belonging to the said Mary Badderley unto the said George / Ebenezer Knight the younger his executors administrators or assigns for and during the term of the life of the said George Ebenezer Knight the elder and for all other the estate and interest of the said Howard William / Mansfield Jackson and Winifred Maria his wife and the said George Ebenezer Knight the elder therein And to have hold receive take and enjoy all other the Hereditaments and Premises hereinbefore assigned or intended so / to be and the full and whole benefit and advantage thereof unto the said George Ebenezer Knight the younger his executors administrators and assigns absolutely And this Indenture further witnesseth that for / the considerations aforesaid the said Howard William Mansfield Jackson and Winifred his wife in persuance and execution of the power or authority in this behalf contained in the within written Indenture Do and each / of them Doth by these presents absolutely and irre vocably make constitute and appoint the said George Ebenezer Knight the younger his executors administrators to be the true and lawful substitute and substitutes of / the said Winifred Maria Jackson and of the said Howard William Mansfield Jackson and Winifred Maria his wife and of each of them and of their and each of their executors administrators for him her or their and / in her or their name or names or in the name or names of the said George Ebenezer Knight the elder his executors or administrators to execute and exercise all and every or any of the powers and authorities / expressed and contained in the within written power of Attorney in as full ample and effectual a manner to all intents and purposes as they the said Howard William Mansfield Jackson and Winifred Maria his wife or either / of them could have executed and exercised the same if these presents had not been made and generally to do and execute all such acts matters and things as may be requisite in the premises and to appoint from time / to time a substitute or substitutes for all or any of the purposes aforesaid the said Howard William Mansfield Jackson and Winifred Maria his wife and each of them and the said George Ebenezer Knight the elder / so far as they or any or either of them lawfully can hereby ratifying and conforming and agreeing to ratify and conform whatsoever the said George Ebenezer Knight the younger his executors or administrators or his / substitute or substituates shall lawfully do or cause to be done in or about the Premises And the said Howard William Mansfield Jackson for himself his heirs executors and administrators and for and against the acts / and defaults only of himself or of the said Winifred Maria his wife or of any person or persons claiming or to claim through under or in trust for their or either of them covenants with the said George Ebenezer Knight the younger his / executors administrators and assigns that notwithstanding any act deed or default of the said Howard William Mansfield Jackson and Winifred Maria his wife or either of them or any person or persons lawfully claiming under or in / trust for them or either of them the said Howard William Mansfield Jackson and Winifred Maria his wife and George Ebenezer Knight the elder or some or one of them have or one of them hath power and authority hereby to assign / or otherwise assure the said Hereditaments Policy and Premises in manner aforesaid and that notwithstanding any such act or default the same Hereditaments Policy and Premises shall henceforth be held and enjoyed accordingly free from all / incumbrances made done or suffered by them or either of them or any persons or person claiming under or in trust for them or either of them And shall from time to time and at any time or times hereafter at the cost of the person or persons / requiring the same be further or more effectually or satisfactorily assured by them or either of them and all persons claiming under or in trust for them or either of them by such acts deeds or either assurances as the said George Ebenezer Knight the / younger his executors administrators or assigns shall reasonably require and tender to bedone executed or made In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first before Knight hath applied to the said Winifred Maria ffisher to lend him the Sum of One hundred and fifty pounds which the said Winifred / Maria ffisher hath agreed to do on having the repayment thereof and other the Hereditatments and Premises / thereinbefore assigned and the full and whole benefit and advantage thereof unto the said Winifred Maria ffisher her executors administrators and assigns absolutely together with such powers and subject to the proviso hereinafter expressed And the said George Ebenezer Knight doth hereby give and grant unto the said / Winifred Maria ffisher her executors administrators or assigns full power and authority as the Attorney or Attorneys and in the names or name of the said George Ebenezer Knight / his executors or administrators or in her or their own name or names or otherwise howsoever as may be deemed necessary or prudent to compel the performance of the several / Covenants of the said Mary Sheaf contained in the said agreement hereinbefore assigned and by action suit or otherwise to recover damages for nonperformance thereof and also to ask / demand and receive or by action suit or otherwise to recover and compel payment of or satisfaction for all or any of the monies to become payable by virtue of the aforesaid Policy or / other monies to become vested in her or them by virtue hereof and to compound and agree to take real or personal Securities in respect thereof if the or they shall think prudent and is subject / and refer any and every question relative thereto to arbitration as she or they may think prudent and to revoke any submission and set aside any Award and otherwise to act relative to / any and every such Arbitration as she or they may think proper and give and execute receipts and discharges for all monies to be paid to her or them by virtue hereof and generally / to act and so in and about the Premises ali the Hereditaments she or they shall think proper and that either personally or by substitutute or substitutes to be appointed and removed or discharged by / her or them when and as she or they may think proper the said George Ebenezer Knight hereby giving and granting the full and whole power and authority of him his executors and administrators / in the premises unto the said Winifred Maria ffisher her executors administrators and assigns and satisfying and confirming all and whatsoever may be done by the said Winifred Maria ffisher her / executors administrators or assigns or her or their substitute or substitutes in the premises by virtue of these presents Provided always that if the said George Ebenezer Knight his heirs / executors administrator or assigns shall well and truly pay unto the said Winifred Maria ffisher her executors administrators or assigns at or in the Common Dining Hall of Lincolns Inn in the / County of Middlesex the full sum of One hundred and fifty pounds sterling at the rate of five pounds per centum per annum computed from the day of the date hereof at the times and in manner / following (that is to say) the said Sum of One hundred and fifty pounds on the twenty fourth day of May - which will be in the year of our Lord One thousand eight hundred and forty five / and the Interest of the said Sum of One hundred and fifty pounds by equal half yearly payments on the twenty fourth day of November and the twenty fourth day of May - in each year in the / meantime without any deduction whatsoever And also on demand well and truly pay or cause to be paid unto the said Winifred Maria ffisher her executors administrators or assigns all rents fines / heriots and other expences which the said Winifred Maria ffisher her executors administrators or assigns may have paid or incurred in respect of the said Copyhold Hereditatments not exceeding / with the said Sum of One hundred and fifty pounds the Principal Sum of One hundred and ninety five pounds with Interest for the same at the rate aforesaid from the time or respective times of / the expenditure thereof then from and immediately after such payment shall be so made as aforesaid Subject nevertheless and without prejudice in the meantime to the application of any monies to be received by / virtue of these presents in payment of the Principal money and Interest hereby secured and the execution by the said Winifred Maria ffisher her executors administrators or assigns in the meantime also of the powers hereby vested in her or them relative to the hereby assigned Premises.

She the said Winifred Maria ffisher her executors administrators or assigns shall and will at the request costs and charges of the said George / Ebenezer Knight his respective executors administrators and assigns reassign unto him or his respective executors administrators or assigns / or otherwise as he or they shall direct the said Hereditaments and premises Agreement and Covenants Policy and Premises hereby assigned / And in case default shall be made in payment of the moneys or interest at the times and in manner aforesaid or in case he or they shall make default in the / performance of any of the Covenants of him the said George Ebenezer Knight hereinafter contained then without prejudice to all rights and remidies of the said / Winifred Maria ffisher her executors administrators or assigns in the premises by foreclosure or otherwise the said WInifred Maria ffisher her executors administrators / or assigns may at any time or times thereafter if and when she or they shall think proper upon giving one Calendar Months notice thereof in Writing to the said George Ebenezer Knight his executors administrators or assigns or leaving the same for him or them at his or their then or last known usual place of abode / case at the expiration of such notice all monies then actually due for Principal Interest and Costs or otherwise under the these presents be not previously paid and / discharged absolutely sell and disposed of either by Public Action or private Contract or partly by both as she or they shall think proper the said hereditaments and / premises hereby assigned or any either of them or any part or parts thereof for the most money which may be reasonably gotten with full power for her or / them to buy in and rescind any Contract and resell the premises in manner aforesaid with like power aforesaid without being liable for any loss thereby and to make / and execute x x x x x x all such deeds assignments and assurances as she or they shall think fit for carrying such sale or sales into effect and to sell the said premises / subject to such Conditions as to nonproduction of Title or otherwise as she or they may think proper And it is hereby declared and agreed that the said Winifred Maria / ffisher her executors administrators or assigns shall with and out of the monies to arise from the Sale of the said Premises in the first place retain pay and discharge / all costs of and incident to such Sale or Sales or otherwise relative to the premises and in the next place retain pay and discharge the said Principal Sum hereby / secured whether then actually due or not and all such other sums aas may have been paid by the said Winifred Maria ffisher for rents fines heriots and other outgoings and expences as / hereinbefore mentioned and all Interest then due thereon and in case there be any surplus money after the several payments aforesaid shall pay the same unto the said George / Ebenezer Knight his executors asministrators or assigns And it is hereby declared and agreed that all Contracts Deeds Agreements Acts and things to be made done entered into or / exemted by the said Winifred Maria ffisher her executors administrators or assigns in or about the Sale and Assurance of the said Premises or otherwise in execution of the powers / or purposes of these Presents shall be valid and effectual without any further or other assent privity or concurrance of the said George Ebenezer Knight his executors administrators / or assigns or any other person whatsoever and that the receipts of the said Winifred Maria ffisher her executors administrators or assigns shall be sufficient discharges to all / Purchasers and Tenants and all other persons for all purchase monies and rents of the said Premises and for all or any money whatsoever to be paid to the said Winifred Maria / ffisher by virtue thereof and shall discharge such Purchasers tenants and other persons from seeing to the application thereof and from all consequences of loss misapplication or / nonapplication thereof and that as Purchasers tenants or other peerson shall be bound to enquire whether any Principal money or Interest remain due thereon or whether any / such Notice of Sale as aforesaid shall have been given or otherwise to see the necessity or propriety of any Sale or other act or thing to be made or done in pursuance thereof / And the said George Ebenezer Knight doth hereby for himself his heirs executors and administrators cosnant with the said Winifred Maria ffisher her executors / administrators and assigns that he the said George Ebenezer Knight his heirs executors or administrators shall and will pay the said Principal Sum of One hundred and fifty / pounds and Interest at the times and in manner hereinafter appointed for payment thereof according to the Proviso hereinbefore contained And also shall and will in the / meantime and until full payment of the principal Sum and Interest aforesaid well and truly pay or cause to be paid all taxes rents fines heriots and other outgoings which / shall become payable in respect of the said Copyhold Hereditaments And further that in the event of the said Winifred Maria ffisher paying any Sum or Sums of money / in respect of such taxes rents fines heriots or other outgoings or any of them he the said George Ebenezer Knight his executors or administrators shall and will on demand / repay or cause to be repaid unto the said Winifred Maria ffisher her executors or administrators the Sum or Sums so paid by her with Interest thereon at the rate of five pounds / per centum per annum from the respective times of such payments being made by the said Winifred Maria ffisher And that he the said George Ebenezer Knight now hath good / right and title hereby to assign the said premises unto the said Winifred Maria ffisher in manner and form aforesaid according to the purport and true intent and meaning / hereof And that the said Agreement herein assigned and Covenants therein contained and also the said Policy of the Assurance are now respectively good valid and subsisting and / not released or otherise incumbered and that it shall be lawful for the said Winifred Maria ffisher her executors administrators or assigns to enter upon and peaceably and / quickly to have hold and enjoy and receive and take the rents and profits of the said Copyhold hereditaments and Premises hereinbefore assigned and also peaceably and quietly / to have hold receive take and enjoy the other premises hereby assigned under and according to these presents without any interruption claim or demand of the said George / Ebenezer Knight his executors administrators or assigns or any other person whomsoever And that free and clear of from and against all manner of former and other / Mortgages Assignments Charges and Incumbrances whatsoever And moreover that he the said George Ebenezer Knight his executors and administrators and all persons / whomsoever lawfully or equitably claiming any estate right title trust or Interest of in to or out of the said premises hereby assigned shall and will at all times hereafter at the /

Request of the said Winifred ffisher her executors administrators or assigns but at the costs of the said George Ebenezer / Knight his executors administrators or assigns until the said premises be sold and disposed of under the powers therein / contained and afterwards at the Costs of the person or persons requiring the same make execute and promise all such / further Assurances of the aforesaid Premises unto the said Winifred Maria ffisher her executors administrators or assigns / for the respective Estates therein hereby vested in the said Winifred Maria ffisher as by the said Winifred Maria ffisher her executors administrators or assigns shall be reasonably / required And moreover that he the said George Ebenezer Knight his executors administrators or assigns shall and will until the monies and interest hereby devised be paid / and discharged sufficiently insure the said Hereditaments hereby assigned and all other Buildings erected or hereafter to be erected thereon against loss by fire in some reputable / ffire Office in London in the joint names of the said George Ebenezer Knight his executors administrators or assigns and the said Winifred Maria ffisher her executors administrators / or assigns and from time to time deliver over the Policy of each Insurance and the receipts for the Premium and duty thereon unto the said Winifred Maria ffisher her executors / administrators or assigns and that in case the said George Ebenezer Knight his executors administrators or assigns shall neglect to make or keep up such Insurance or to deliver / over any Policy or receipt as aforesaid then without prejudice to all right and remidies for breach of this Covenant or otherwise it shall be shall be lawful for the said Winifred Maria ffisher / her executors administrators or assigns to make and keep up such Insurance or Insurances as she or they shall think fit on the said premises And the said George Ebenezer / Knight his heirs executors and administrators shall on demand repay to the said Winifred Maria ffisher her executers administrators or assigns all money which she they / or any of them shall expend on account of such Insurance with Interest thereon at the rate of five pounds per centum per annum and all such money and Interest shall / also be charged upon the Premises hereby assured and raisable under the powers herein contained in manner as the said sum of one hundred and fifty pounds hereby / secured And further that he the said George Ebenezer Knight his executors or administrators shall and will at all times hereafter whilst any Principal money or interest / shall remain unpaid by virtue of these presents well and truly pay or cause to be paid the Annual Premiun from time to time to grow due upon the aforesaid Policy of Life / Insurance hereby assigned by the said George Ebenezer Knight as aforesaid three days at the least every year before the same Annual Premium shall according to the / laws of the said Policy become payable and immediately after such payment of the said Annual Premium from time to time deliver over the receipts for the same to the said / Winifred Maria ffisher her excutors administrators or assigns And also shall and will pay all such said sums of money and do all such other acts as shall be / necessary for keeping on foot the same Policy and the life Insurance thereby made out that the said George Ebenezer Knight his executors or administrators shall not nor / will do or omit any act or thing which can or will invalidate or render void or voidable the said Policy of Life Insurance And further that in case the said George / Ebenezer Knight his executors or administrators shall neglect or omit to pay such Premium or keep up such Life Insurance as aforesaid or to deliver over to the said Winifred / Maria ffisher her executors or administrators any such receipt or shall in any other manner not perform the Covenents hereby hereinbefore contained or any of them / then in every such case it shall be lawful for the said Winifred Maria ffisher her executors administrators or assigns to keep up and continue such Life Insurance or / Insurances as aforesaid or effect and keep up so long as she or they shall think proper - any other Insurance on the Life of the said George Ebenezer Knight as she or they shall think / fit for any Sum or Sums as she or they shall think sufficient to secure all Principal money and Interest to become due by virtue of presents during so long a time as any money / shall remain due and unpaid by virtue or these presents And that all Sum or Sums of money to be paid and expence to be incurred by the said Winifred Maria ffisher her executors / administrators or assigns in the keeping up making or effecting such Life Insurance or Insurances as aforesaid together with Interest thereon at the rate of five pounds per centum per / Annum from the time of paying the sum shall be a charge upon all and every the Premises hereby made a [---ity] for the said sum of One hundred and fifty pounds and Interest / and be reasonable in like manner under the powers herein contained as the said Sum of One hundered and fifty pounds and Interest And further that he the said George Ebenezer [Knight] his executors / or administrators shall and will on demand pay the said Sums of money and expences and Interest to the said Winifred Maria ffisher her executors administrators or assigns And it is / hereby declared and agreed that she the said Winifred Maria ffisher her executors administrators or assigns shall stand possessed of any further Life Policy or Policies which shall or / may hereafter be effected by virtue of the aforesaid provisions and the monies to become payable and be received thereon for better serving to her all Principal monies and Interest / hereby secured as aforesaid and shall apply and dispose thereof And all monies to be received or recovered by virtue of such further Policy or Policies respectively in like manner and / with the like powers and subject to the like provisions and equity of redemption as are herein expressed concieving the aforesaid Life Policy and Premises hereby assigned by the said / George Ebenezer Knight and the monies to be received by virtue thereof if the same should continue in force And it is hereby declared and agreed that the said Winifred Maria ffisher / her executors administrators or assigns shall not be answerable or accountable for any more monies or property than she or they shall actually receive by virtue thereof nor for any loss / or misfortune which may happen thereto or in the execution of the powers or purposes of these presents without her or their willful default Provided and it is hereby declared that until default be made / in the payment of any of the monies hereby secured it shall be lawful for the said George Ebenezer Knight his executors or administrators to hold and enjoy the said hereditaments and premises and / receive the rents and profits thereof Provided lastly and for the purposes of the Stamp Laws it is hereby declared that the total amount of the Principal money hereby secured and to be / ultimately reseasonable thereupon shall not exceed One hundred and ninety five pounds In witness whereof the said parties to these presents have hereunto set their hands and seals the / day and year first before written.

[right hand] Be it remembered that the within mentioned Principal Sum of Four hundred / and fifty pounds with a considerable arrear of interest thereon being due to the within / described Hephzibah Hughes now the Wife of Benjamin Luxton of Evesham in the County / of Worcester Farmer (the within mentioned Rebecca Hughes having departed this life on or / about the Twenty first day of March One thousand eight hundred and fifty five) they the / said Benjamin Luxton and Hephzibah his Wife did by an Indenture dated the Twenty / fourth day of December One thousand eight hundred and fifty five duly acknowledge by the / said Hephzebah Luxton in consideration of One hundred and three pounds to them / paid by George Malin of Harvington in the County of Worcester Esquire grant and convey / unto and to the use of said George Malin his heirs and assigns for ever free from / incumbrances All that Messuage Cottage or Tenement Garden Orchard and backside thereof / belonging comprised in the within written Indenture and described as situate in Harvington / in the County of Worcester formerly in the possession of William Huband afterwards of James / Jones since of the Widow Jones and then of Moses Jones And in the same Indenture / is contained a Covenant on behalf of the said Benjamin Luxton for within himself / and Hephzebah his Wife for the production and safe custody of the within / written Indenture of Mortgage.

This indenture made the twenty eighth day of February One thousand eight hundred and fifty Between / George Hatton formerly of Bidford in the County of Warwick Mercer but now of / Birmingham in the same County and Ann his Wife of the first part George / Ebenezer Knight the Elder formerly of Harvington in the County of Worcester Shopkeeper but / now of Wolverhampton in the County of Stafford Seedsman the second part Hannah Knight Wife of the said George Ebenezer Knight the Elder of the third part George Ebenezer Knight the Younger of Wolverhampton aforesaid Seedsman / of the fourth part and Rebecca Hughes and Hephzebah Hughes both of Evesham in the County of Worcester Spinsters of the fifth part / Whereas by Indentures of Lease and Release dated respectively the fourteenth and fifteenth days of October One thousand eight hundred and twenty nine The Release / being made between the said George Hatton and Ann his Wife of the first part the said George Ebenezer Knight the Elder of the second part and William / Bullock Farmer of the third part After reciting that the said Ann Hatton was under the Will of her late Father William Hatton deceased seized by her and her heirs / of the reversion in fee simple immediately expectant on the decease of her mother Ann Hatton of the hereditaments thereafter conveyed It was Witnessed that for the / consideration therein mentioned the said George Hatton and Ann his Wife did grant and release unto the said George Ebenezer Knight the Elder and his heirs / the freehold Cottage Orchard and hereditaments hereinafter described and intended to be hereby conveyed with their Appurtenances to hold the same in remainder / immediately expectant on the decease of the said Ann Hatton unto the said George Ebenezer Knight and his heirs to the usual uses in bar of dower for the benefit of / the said George Ebenezer Knight his appointees heirs and assigns for ever and the said George Hatton covenanted that he and Ann his Wife would buy a fine unto the / said George Ebenezer Knight and his heirs of the same hereditaments enure when levied to the Uses thereinbefore declared thereof And whereas the said Ann Hatton / is since dead And whereas by Indentures of Lease and Appointment and Release dated respectively the first and second days of June One thousand eight hundred and / thirty five the Appointment and Release being made between the said George Ebenezer Knight the Elder of the first part Samuel Amos the Elder of the second part and / Samuel Amos the Younger of the third part and the said Freehold Hereditaments were appointed and conveyed unto the said Samuel Amos the Elder his heirs and / assigns for ever by way of Mortgage for the payment for the sum of One hundred pounds and Interest on the first of December then next and in the same / Indenture was contained a power of sale of the said hereditaments in case of Default in payment of the said principal and Interest monies on the day / appointed And whereas by an Indenture dated the twenty fourth day of December last and made between the said Samuel Amos the Elder of the first part / the said George Ebenezer Knight the Elder of the second part John Oldaker and John Edwards of the third part and the said George Ebenezer Knight the Younger of / the fourth part. It was Wittnessed that for the considerations therein mentioned the same freehold hereditaments were conveyed and assured unto and to the use of the said George Ebenezer / Knight the Younger his heirs and assigns for ever absolutely And whereas at a Court Baron of the Dean and Chapter of the Cathedral Church of Christ and the Blessed Mary the Virgin of / Worcester holden for the Manor of Harvington on the fourteenth day of October One thousand eight hundred and eighteen One Messuage and half yard land with the Appurtenances were granted to Samuel / Stone Charles and Edmund Charles In trust for Mary Sheaf and to surrender when by her her executors administrators or assigns required to hold for the term of their lives and the life of the longer / liver of them successively according to the Custom of the said Manor under and subject to the yearly rent and to a heriot when it should happen suit of Court customs and services therefore due / and of right accustomed And at the same Court the reversion of the said Messuages and half yard land with the appurtenances was granted to Henry Sheaf and Charles Sheaf In trust for the / said Mary Sheaf and to surrender when by her her executors administrators or assigns required to hold for the term of their lives and the longer liver of them successfully according to the Custom of the / said Manor immediately after the decease surrender or forfeiture of the said Samuel Stone Charles and Edmund Charles under and subject to the yearly rent a heriot when it should happen / suit of Court and other customs and services therefore due and of right accustomed And whereas by an Agreement dated the sixteenth day of July One thousand eight hundred and / thirty and made between the said Mary Sheaf of the one part and Mary Badderley of the other part in consideration of Sixty pounds to the said Mary Sheaf paid by the said Mary / Badderley all that Piece and Parcel of Land containing together Two thousand four hundred and twenty square yards or thereabouts part of the half yard land comprised in the before recited / Grants bounded Southward by a public Road or Street Eastward by part of the Glebe belonging to the Benefice of Harvington and on all other sides by part of the remainder of the / Premises comprised in the said recited grants was by the said Mary Sheaf covenanted to be conveyed and assured to the said Mary Badderley her executors administrators or assigns / to hold the same thenceforth during the lives of the said Samuel Stone Charles and Edmund Charles and the Surviver of them and after the Decease surrender or forfeiture / of the said Samuel Stone Charles and Edmund Charles during the lives of the said Henry Sheaf and Charles Sheaf and the surviver of them successively / in such manner and under and subject to the same terms and conditions so far as the same were applicable to the said piece or parcel of land thereby agreed to be sold as the / said Mary Sheaf then held the same at the yearly apportioned rent of two shillings reserved by the aforesaid grants And in the said Agreement are contained Covenants on the / part of the said Mary Sheaf from time to time as the lives for which the said half yard land for the time being was holden should drop to endeavour to procure a fresh grant or grants / thereof the some other lives so that as for as might be the same might always be held in trust for the said Mary Sheaf her executors administrators or assigns for two / subsisting lives in possession and two in reversion and at the costs of the said Mary Badderley her executors administrators or assigns to assure to / her and them the said piece or parcel of land on payment of her proportion of the value of the heriots to be rendered and of the fees fines and / expences to be paid upon every such renewal to be ascertained as therein is mentioned And whereas the said Mary Badderley / by her Will dated the twenty eighth day of February One thousand eight hundred and thirty two devised and bequeathed the said piece or parcel of Land / and all the Messuages or Tenements Cottages and other the erections and buildings their lately erected thereon unto the said John Oldaker and John Edwards their executors administraotrs / and assigns upon trust out of the rents and profits thereof to pay the rents heriots fines and expences payable in respect of the same premises and to procure renewals of the said Grants as /

The Deed marked A was this day produced before us and acknowledged by Ann Hatton therein named / to be her act and deed previous to which acknowledgement the said Ann Hatton was examined by us / separately and apart from her husband touching her knowledge of the contents of the said Deed and her consent / thereto and declared the same to be freely and voluntarily executed by her Dated this twenty eighth day of February / in the year One thousand eight hundred and fifty. Therein is mentioned and (subject to an annuity directed to be paid thereout for the benefit of Isabella Knight on her attaining the age of twenty one years which never / became payable by reason of her decease under that age) to pay the rents and profits of the same premises to George Ebenezer Knight the Elder for life and after his decease to the said Hannah / Knight for life for her sole and separate use and benefit and after the Decease of the survivor of them to the said Isabella Knight for her separate use for life and after her decease in case she left issue / living at her decease upon trust to sell the same premises and Invest the monies arising therefrom as therein is mentioned and stand possessed thereof In trust for her Children as therein mentioned but in case the said Isabella Knight should have no Child living at / her decease as was the case) then that the said Trustees should stand possessed of the said land and premises and the rents thereof upon and for such and the same trusts intents and purposes / and with under and subject to such and the same powers and declarations in favour or for the benefit of the said George Ebenezer Knight the Younger and his Children or Child respectively as / were therein before declared in favour of the said Isabella Knight and her Children or Child respectively and the said Mary Badderley appointed the said John Oldaker and John Edwards Executors of / her Will And whereas the said Testatrix departed this life without having revoked her said Will and was buried on the fifth day of February One thousand eight hundred and thirty / seven and her said Will was duly proved in the Prerogative Court of the Archbishop of Canterbury on the fifteenth day of August One thousand eight hundred and thirty seven by her Executors / And whereas by another Deed of Agreement dated the tenth day of April One thousand eight hundred and forty one and made between the said Mary Sheaf of the one part and / the said George Ebenezer Knight the Elder of the other part In consideration of the sum of Thirty Pounds and ten Shillings to the said Mary Sheaf paid by the said George Ebenezer Knight / the Elder All that piece or parcel of Land containing together Six hundred and ten square yards or thereabouts other part of the said half yard land comprised in the said before / noted Grants bounded Southward by the said Public Road or Street Eastward by part of the said Glebe belonging to the benefice of Harvington on the North side by the Land so / purchased by the said Mary Badderley and on the West side thereof by the residue of the Land belonging to the said Mary Sheaf was by the said Mary Sheaf covenanted to be conveyed / and assured to the said George Ebenezer Knight the Elder his Executors administrators and assigns to hold the same thenceforth during the lives of the said Samuel Stone Charles and / Edmund Charles and the life of the longer liver of them and after the decease surrender or forfeiture of the said Samuel Stone Charles and Edmund Charles during the lives / of the said Henry Sheaf and Charles Sheaf and the longer liver of them successivley in such manner and under and subject to the same terms and conditions so far as the same / were applicable to the said piece or parcel of land thereby agreed to be sold as the said Mary Sheaf then held or was entitled to the same at the yearly apportioned rent of One Shilling / reserved by the aforesaid grants And in the Deed now in recited are contained Covenants on the part of the said Mary Sheaf from time to time as the lives for which the said half / yard land for the time being was holden should drop to endeavour to procure a fresh grant or grants thereof for some of the lives so that as far as might be the same might always be / held In trust for the said Mary Sheaf her executors administrators or assigns for two subsisting lives in possession and two in reversion and at the costs of the said George Ebenezer / Knight the Elder his executors administrators or assigns to assure to him and them the said piece or parcel of land on payment of his proportion of the value of the heriots to be / rendered and of the fees fines and expences to be paid upon every such renewal to be ascertained as therein is mentioned And whereas by a Policy of Insurance under the / hands and seals of three of the Directors of the Hand in Hand Insurance Society dated the twenty ninth day of April One thousand eight hundred and forty four and / numbered 783 in consideration of the annual Premium of Six Pounds three Shillings and eleven Pence the Capital Stock and funds of the said Society were made / liable to pay to the executors administrators or assigns of the said George Ebenezer Knight the Elder within three Calendar months after his Decease the Sum of One / hundred and fifty Pounds And whereas by an Indenture of Mortgage dated the twenty fourth day of May One thousand eight hundred and forty four expected / to be made between the said George Ebenezer Knight the Elder of the one part and Winifred Maria Fisher Spinster of the other part the said Pieces of land and / Premises comprised in the said two several hereinbefore recited Agreements and the Messuages and Buildings thereon and the same Agreement and the benefit of the / Covenants therein contained and also the said recited policy of Assurance and the money to become payable by virtue thereof were assigned to the said Winifred Maria / Fisher her executors administrators and assigns to hold the said Piece of Land and Premises then late belonging to the said Mary Badderley unto the said Winifred / Maria Fisher her executors administrators and assigns for the life of the said George Ebenezer Knight the Elder and to hold the other hereditaments and Premises unto / the said Winifred Maria Fisher her executors administrators and assigns Subject to the Proviso for Redemption thereof in the said Indenture contained on payment / by the said George Ebenezer Knight the Elder to the said Winifred Maria Fisher her executors administrators and assigns of the sum of One hundred and fifty Pounds and / Interest on the twenty fourth day of May then next And by the Indenture now in recital the said George Ebenezer Knight appointed the said Winifred Maria Fisher / her executors administrators or assigns his Attorney or Attornies unrevocable to compel the Performance of the several covenants contained in the said recited / agreements and to obtain payment of the monies to become payable by virtue of the said Policy of Assurance with power to appoint a substitute or substitutes for all / or any of the purposes aforesaid And the Indenture now in recital is contained a power for the said Winifred Maria Fisher her executors administrators or assigns in / case should default should be made in payment of the Principal money and Interest absolutely to sell and dispose of the said Premises in manner therein mentioned / And whereas by an Indenture indorsed upon the last recited Indenture and dated the nineteenth day of November last expressed to be made between Howard / William Mansfield Jackson Gentleman and Winifred Maria his Wife of the first part the said George Ebenezer Knight the Elder of the second part and the said George / Ebenezer Knight the Younger of the third part After reciting that on the twenty seventh day of June then last the said Winifred Maria Fisher intermarried with and / became the Wife of the said Howard William Mansfield Jackson and that the sum of One hundred and ninety Pounds then remained owing to the said Howard William / Mansfield Jackson and Winifred Maria his Wife by virtue of the last recited Indenture and that the said George Ebenezer Knight the Younger had contracted with them / for the absolute purchase of the hereditaments policy and premises thereby granted and assigned at the price of One hundred and ninety Pounds It was by the Indenture / now on recital witnessed that in consideration of the sum of One hundred and ninety Pounds by the said George Ebenezer Knight the Younger to the said Howard William

Mansfield Jackson and Winifred Maria his Wife paid they the said Howard William Mansfield Jackson and Winifred Maria his Wife with / the approbation of the said George Ebenezer Knight the Elder did grant and assign and he the said George Ebenezer Knight the Elder did grant and assign and confirm unto the said George Ebenezer Knight the Younger his Executors administrators / and assigns All and singular the hereditaments policy and Premises comprised in and assured by the said last recited Indentures To hold the piece of Land and Premises / late belonging to the said Mary Badderley unto the said George Ebenezer Knight the Younger his executors administrators or assigns during the life of the said George / Ebenezer Knight the Elder and to hold receive and take all other the hereditaments and Premises thereinbefore assigned and the full benefit and advantage thereof / unto the said George Ebenezer Knight the Younger his executors administrators and assigns absolutely And by the same Indenture the said Howard William Mansfield / Jackson and Winifred Maria his Wife in pursuance of the power for that purpose contained in the last mentioned Indenture irrevocably appointed the said George / Ebenezer Knight the Younger his executors or administrators to be the substitute and substitutes of the said Winifred Maria Jackson and of the said Howard William Mansfield / Jackson and Winifred Maria his Wife and of each of them and of each of their executors or administrators and for him her or them and in his her or their name or / names and of the said George Ebenezer Knight the Elder his executors or administrators to execute and exercise all the powers and authorities contained in the power / of Attorney in the said last recited Indenture contained and to appoint vfrom time to time a substitute or substitutes for all or any of the purposes aforesaid the / said Howard William Mansfield Jackson and Winifred Maria his Wife and each of them and the said George Ebenezer Knight the Elder thereby ratifying and / confirming whatsoever the said George Ebenezer Knight the Younger his executors or administrators or his substitute or substitutes shall lawfully as or cause to be / done in the Premises And whereas at a Court Baron holden for the said Manor of Harvington on the twenty fourth day of October last past the said one / Messuage and half yard land with the appurtenances or the lands which had been allotted to or in lieu of the said Premises under the Harvington inclosing Act / were (having been first duly surrendered ) granted to the said Samuel Stone Charles and Henry Sheaf In trust as to the said piece of land containing two thousand / four hundred and twenty square yards or thereabouts the part thereof as sold by the said Mary Sheaf to the said Mary Badderley deceased as hereinbefore is recited / together with the Messuages Tenements Cottages and other buildings erected thereon and as to the said piece of Land containing six hundred and ten square yards or / thereabouts other part thereof so sold by the said Mary Sheaf to the said George Ebenezer Knight the Elder as hereinbefore is recited Together with the appurtenances for the / said George Ebenezer Knight the Younger and as to all the rest and residue of the premises in trust for the said Mary Sheaf to surrender when by them their executors / administrators or assigns required the premises aforesaid in the said parts thereof so belonging to them respectively as aforesaid with the appurtenances to hold unto / the said Samuel Stone Charles and Henry Sheaf Upon Trust as aforesaid for the term of their lives and the longer liver of them successively according to the custom of / the said Manor paying therefore yearly to the Lords four shillings and four pence at the usual times a heriot when it should happen suit of Court and all other / customs and services therefore due and of right accustomed And at the same Court the reversion of the same Premises with the appurtenances was granted to / Charles Sheaf and Henry Sheaf the Younger In trust for the said George Ebenezer Knight the Younger and Mary Sheaf in the parts and proportions aforesaid to / surrender where by them their executors administrators or assigns required the reversion of the same premises in the said parts thereof so belonging to the said / George Ebenezer Knight the Younger and Mary Sheaf respectively as aforesaid with the appurtenances to hold unto the said Charles Sheaf and Henry Sheaf the Younger / Upon Trust as aforesaid for the term of their lives and the longer liver of them successively according to the custom of the said Manor immediately after the decease / surrender or forfeiture of the said Samuel Stone Charles and Henry Sheaf under and subject to the said yearly rent of four shillings and four pence a heriot / when it should happen suit of Court and all other customs and services therefore due and of right accustomed And whereas by a Policy of assurance / under the hands and seals of three of the Directors of the said Hand in Hand Assurance Company dated the twenty second day of February Instant and / numbered 1913 In consideration of the annual premium of Seven Pounds nine Shillings and five pence the Capital stock and funds of the said Society / were made liable to pay the said George Ebenezer Knight the Younger his executors administrators or assigns within three calendar months after the decease / of the said George Ebenezer Knight the Elder the sum of One hundred and fifty Pounds And whereas the said George Ebenezer Knight the Younger being / in want of the sum of Four hundred and fifty Pounds the said Rebecca Hughes and Hephzebah Hughes have agreed to lend him the same out of monies to which / they are jointly entitled upon having repayment thereof secured with lawful Interest in manner hereinafter appearing And whereas upon treaty for the said / intended Loan it was agreed that the reversionary life Estate to which the said Hannah Knight is entitled for her separate use and benefit in that portion of the Copyhold / Premises lately belonging to the said Mary Badderly under the said recited Will should be included in such Mortgage securing And whereas no fine having been / levied by the said George Hatton and Ann his Wife of the said Freehold hereditaments so intended to be conveyed by the said first hereinbefore recited Indentures of Lease / and Release pursuant to the Covenant for that purpose in the said Indenture of Release contained the said George Hatton and Ann his Wife have at the request of as well the / said George Ebenezer Knight the Elder as the said George Ebenezer Knight the Younger agreed to join in these Presents for the purpose of more effectually assuring the said / Freehold Hereditaments unto the said Rebecca Hughes and Hephzebah Hughes by way of Mortgage and the Equity of Redemption thereof subject thereto to the said George / Ebenezer Knight the Younger absolutely in manner hereafter contained Now this Indenture witnesseth that in pursuance of such agreement and in / consideration of the sum of Four hundred and fifty Pounds Sterling to the said George Ebenezer Knight the Younger paid by the said Rebecca Hughes and Hephzebah / Hughes immediately before the execution of these Presents the receipt whereof the said George Ebenezer Knight the Younger doth hereby acknowledge and from the same / doth hereby acquit release and discharge the said Rebecca Hughes and Hephzebah Hughes and each of them their and each of their heirs executors administrators

Assigns Forever. And also in consideration of the sum of ten shillings to the said George Hatton and Ann his Wife paid by the said / Rebecca Hughes and Hephzebah Hughes before the execution hereof (the receipt whereof is hereby acknowledged) They the said George Hatton and Ann his Wife at the request / and by the direction of the said George Ebenezer Knight the Elder and George Ebenezer Knight he Younger testified by their executing these Presents Do and each of them Doth / by these Presents intended to be acknowledged by the said Ann Hatton pursuant to the Statute for the abolition of fines and recoveries and for the substitution of more / simple modes of assurance Grant and release And He the said George Ebenezer Knight the Younger Doth by these presents grant and confirm unto the said Rebecca Hughes / and Hephzebah Hughes and their heirs All that Messuage Cottage or Tenement Garden Orchard and Backside thereto belonging situate and being in Harvington in the County / of Worcester formerly in the possession of William Huband afterwards of James Jones then of Widow Jones and now of Moses Jones between the Dwelling House formerly / of Joseph Ganderton but now of William Hawkes Marshall [blank] on the north side thereof and the Buildings and Barn formerly of / Benjamin Evans afterwards of the said William Hawkes Marshall but now of [blank] on the South side thereof and extending Eastward to a Ground formerly / of Thomas Walford but now of the said William Hawkes Marshall Together with all edifices and buildings commonable rights trees fences ditches ways waters water courses / privilages lights easements profits and appurtenances whatsoever to the said Messuage and Hereditaments belonging or appertaining And the reversion and reversions remainder / and remainders yearly and at the rents and profits thereof And and all the Estate right title interest inheritance use trust property claim and demand whatsoever both at / Law and in Equity of them the said George Hatton and Ann his Wife and George Ebenezer Knight the Younger and every of them in and to the same Premises And all / Deeds and Muniments of Title belonging to the said Premises To have and To hold the said Messuage Cottage or Tenement Garden Orchard Hereditaments / and all other the Premises hereby conveyed or intended so to be unto and to the use of the said Rebecca Hughes and Hephzebah Hughes their heirs and assigns for ever / subject nevertheless to the Proviso for Redemption hereinafter contained And the said George Hatton for himself his heirs executors and administrators doth hereby covenant / and declare with and to the said Rebecca Hughes and Hephzebah Hughes their heirs and assigns that neither he nor his Wife the said Ann Hatton have at any time heretofore done permitted / or executed any act (Deed or thing (except as appears by these presents) whereby the hereditaments and Premises hereinbefore conveyed are charged incumbered or prejudicially / effected in Title Estate or otherwise howsoever And this Indenture also witnesseth that for the considerations aforesaid she the said Hannah Knight with the / concurrence of her Husband the said George Ebenezer knight the Elder testified by his executing these presents Doth appoint and and also assign and dispose of And he the said / George Ebenezer Knight the Younger doth by these presents grant assign and confirm unto the said Rebecca Hughes and Hephzebah Hughes their executors administrators / and assigns All that peice or parcel of land containing together two thousand four hundred and twenty square yards or thereabouts situate and being within / and Parcel of the Manor of Harvington so purchased by the said Mary Badderley of the said Mary Sheaf as hereinbefore is recited together with the Messuage / Tenements Cottages and Buildings thereon formerly known as the Hop Pole Inn but now converted into Four several Tenements and now or late in the occupation / of James Tarrant Edward Davis John Hughes and [blank] as Tenants thereof respectively And also the Messuage or Tenement occupied by Thomas Hawkes Together with all and singular other the Premises comprised in the said / first hereinbefore recited Agreement And all the Estate right title Interest property claim and Demand whatsoever of them the said Hannah Knight and George Ebenezer / Knight the Younger and each of them of in to or out of the said promises To have and to hold the said Piece or Parcel of Land Messuages tenements Cottages buildings / hereditaments and all other the Premises lastly hereinbefore assigned or intended so to be unto the said Rebecca Hughes and Hephzebah Hughes their executors administrators / and assigns during the natural lives and life of the said George Ebenezer Knight the Elder Hannah Knight and George Ebenezer Knight the Younger and the survivors / and survivor of them for their own absolute use and benefit subject nevertheless to the Proviso for Redemption hereinafter contained And this Indenture also witnesseth / that for the considerations aforesaid He the said George Ebenezer Knight the Younger Doth by these presents assign and confirm unto the said Rebecca Hughes / and Hephzebah Hughes their executors administrators and assigns All that Piece or Parcel of Land containing Six hundred and Ten square Yards or thereabouts situate / and being within and parcel of the said Manor of Harvington so purchased by the said George Ebenezer Knight the Elder of the said Mary Sheaf as hereinbefore is / recited and all and singular other the Premises if any comprised in the said Hereinbefore recited Agreement of the tenth day of April One thousand eight hundred and forty / one and the several Messuages or Tenements and buildings standing and being thereon or now in the course of erection by the said George Ebenezer Knight the Younger on / some part thereof together with the said Agreement and the full benefit and advantage thereof and all the Covenants therein contained And also all those the said / two several Policies of Assurance herein before recited and the said respective sums of One hundred and fifty Pounds and One hundred and fifty Pounds assured thereby and all / other the sums and sum of money benefits and advantages to be had and recovered or obtained by virtue of the said Policies or either of them with full power and authority to compel / persuance of the Covenants in the said herein before recited Agreement of the tenth day of April One thousand eight hundred and forty one and to ask demand sue for / recover and receive and give effectual releases and discharges for the said sums of One hundred and fifty Pounds and One hundred and fifty Pounds and other the monies / so respectively assured by the said respective Policies when and as the same shall respectively become payable And all the Estate right title Interest property claim and demand / whatsoever of him the said George Ebenezer Knight the Younger in to or out of the said Piece of land Messuages or tenement Policies monies and other the Premises lastly hereinbefore / assigned or intended to be unto And by the said Rebecca Hughes and Hephzebah Hughes their executors administrators and assigns for thier own absolute use and benefit Subject / nevertheless to the Proviso for Redemption hereinafter contained Provided always and it is hereby agreed and declared between and by the said Rebecca Hughes and / Hephzebah Hughes and George Ebenezer Knight the Younger that if the said George Ebenezer Knight the Younger his heirs executors administrators or assigns do and shall on the twenty eighth day of August next

Ensuring the date hereof well and truly pay or cause to be paid unto the said Rebecca Hughes and Hephzebah Hughes or the survivor of them / or the executors or administrators of such survivor or their or her assigns the sum of Four Hundred and Fifty Pounds sterling together with Interest thereon after the rate of / Five Pounds pr centum per annum from the day of the date hereof without any deduction whatsoever then and immediately thereupon They the said Rebecca Hughes and / Hephzebah Hughes their executors administrators or assigns shall and will at the request costs and charges of the said George Ebenezer Knight the Younger his heirs executors / administrators or assigns reconvey and reassign the said Freehold and Copyhold hereditaments and Premises Policies monies and Premises respectively hereby conveyed and / assigned or intended to be in manner following that is to say as the said Copyhold Premises so lately belonging unto the said Mary Badderley unto the said George / Ebenezer Knight the Younger his executors administrators or assigns and the said Hannah Knight if living or to her assigns according to their respective Estates and Interests / in the same or as they he or she shall in that behalf order and direct and as to all and singular other the hereditaments and Premises hereby conveyed and assigned / or intended so to be unto the said George Ebenezer Knight the Younger his heirs executors administrators or assigns or as he or they shall direct according to the respective / natures or qualities thereof free from all incumbrances whatsoever made or committed by the said Rebecca Hughes and Hephzebah Hughes their heirs executors administrators / or assigns And the said George Ebenezer Knight the Younger doth hereby for himself his heirs executors and administrators covenant and agree to and with the said Rebecca / Hughes and Hephzebah Hughes their executors administrators and assigns that he the said George Ebenezer Knight the Younger his heirs executors or administrators shall and will duly pay / or cause to be paid to the said Rebecca Hughes and Hephzebah Hughes or the survivor of them or the executors or administrators of such survivor or their or her assigns the aforesaid sum / of Four hundred and Fifty Pounds and Interest on the day in the aforesaid Proviso or Agreement appointed for payment thereof without any deduction or abatement whatsoever / according to the true intent of these Presents And further that in case the said principal sum of Four hundred and Fifty Pounds shall not be paid on the day hereinbefore / appointed for payment thereof He the said George Ebenezer Knight the his heirs executors or administrators shall and will during so long as the said sum of Four hundred / and fifty pounds or any part thereof shall remain due on the security of these Presents pay or cause to be paid to the said Rebecca Hughes and Hephzebah Hughes or the survivor / of them or the executors or administrators of such survivor or their or her assigns Interest for the said sum of Four hundred and Fifty Pounds or for so much thereof as for the time / being shall remain unpaid after the rate of Five Pounds per centum per annum by equel half yearly payments on the twenty eighth day of February and the twenty eighth day / of August in every year without any deduction whatsoever And further that he the said George Ebenezer Knight the Younger his heirsexecutors or administrators shall / and will during the continuance of the present security from time to time duly pay or cause to be paid the said annual premium of six Pounds three shillings and eleven Pence / and seven Pounds nine shillings and five Pence and such other annual Premium or premiums sum or sums of money (if any) as shall from time to time become / payable for keeping on foot the said Policies of assurance and shall and will forthwith deliver the receipt for every such payment to the said Rebecca Hughes and Hephzebah Hughes or / the survivor of them or the executors or administrators of such survivor or their or her assigns And that of the said George Ebenezer Knight the Younger his heirs executors administrators / shall neglect or refuse to make such payments as aforesaid or any of them at the times aforesaid then and in such case and so often as the same shall happen it shall be lawful / for but not obligatory on the said Rebecca Hughes and Hephzebah Hughes or the suvivor of them or the executors or administrators of such survivor or their or her assigns to pay / the said annual premiums of six Pounds three shillings and eleven Pence and seven Pounds nine shillings and five Pence and such other annual Premium or Premiums / sum or sums of money (if any) as shall from time to time become payable for keepeing on foot the said Policies of Assurance or either of them And further that he the said / George Ebenezer Knight the Younger his heirs executors administrators or assigns shall and will from time to time on demand pay or cause to be paid unto the said Rebecca Hughes and / Hephzebah Hughes or the survivor of them or the executors or administrators of such survivor or their or her assigns all such sum and sums of money as shall have been so paid by / them or her for keeping the said Policies or either of them on foot with Interest for the same after the rate of Five Pounds per centum per annum from the time or respective times of / the same having been paid And that in the meantime and until the same should be so paid with Interest as aforesaid all the hereditaments Policies monies and Premiums hereinbefore / conveyed and assigned or entended so to be shall stand charged with the payment as well of such sum or sums of money and the interest thereon as the said sum of Four hundred / and fifty Pounds and Interest and shall not be redeemed or redeemable until full payment thereof respectively And further that he the said George Ebenezer Knight the Younger / his heirs executors administrators or assigns shall and will from time to time and at all times hereafter during the continuance of this present security at his and their own costs insure / and keep insured from loss or damage by fire all the Messuage or Tenements and other the building now erected or hereafter to be erected on the hereditaments and Premises hereinbefore / conveyed and assigned or indended so to be in the names or name of the said Rebecca Hughes and Hephzebah Hughes or the survivor of them or the executors or administrators of such / survivor or her or their assigns in the Law Fire Insurance Office or such other Office of Insurance as they or she shall from time to time direct to the extent of three hundred Pounds at least / and deliver to them or her proper receipts for the Premiums and duty in respect of such Insurance or Insurances within six days after the same shall become due And that if the said George / Ebenezer Knight the Younger his heirs executors administrators or assigns shall fail so to do it shall be lawful for but not obligatory on the said Rebecca Hughes and Hephzebah Hughes or the / survivor of them or the executors or administrators of such survivor or their or her assigns from time to time as aften as occasion shall require to effect and make such Insurance or / Insurances in their or her names or name to the extent and in manner aforesaid And also to pay any such premium duty sum or sums of money in payment of which default / shall have been made by the said George Ebenezer Knight the Younger his heirs executors administrators or assigns contrary to the aforesaid Covenant and the true intent of these / Presents And also that he the said George Ebenezer Knight the Younger his executors administrators or assigns shall and will from time to time on demand duly pay or cause / to be paid to the said Rebecca Hughes and Hephzebah Hughes or the survivor of them or the executors or administrators of such survivor or her or their assigned all such sum or sums / of money as they she or any of them shall from time to time pay in respect of such Insurance or Insurances as aforesaid with Interest for the same after the rate of Five Pounds per

to be computed from the time or respective times of paying the same and that in the mean time and until such sum / or sums of money shall be so repaid with Interest as aforesaid All and singular the said hereditaments and Premises hereinbefore conveyed and assigned or intended so to be shall / stand charged therewith and shall not be redeemed or redeemable until full payment thereof respectively And it is hereby agreed and declared that in case the said Messuages / or Tenements and other hereditaments or any of them or any part thereof shall at any time or times during the continuance of this Security be burnt down or damaged by fire then / and so often as the same shall happen all such sums of money as may be recovered or received by virtue of any such Insurance as aforesaid shall at the option of the said Rebecca / Hughes and Hephzebah Hughes or the survivors of them or the executors or administrators of such survivor or their or her assigns be expended in the rebuilding or repairing / the said Messuages or Tenements erections buildings and other hereditaments or be retained and applied in discharge of the monies due or to become due on this present Security / And the said George Ebenezer Knight the Younger doth for himself his heirs executors and administrators further covenant and agree with the said Rebecca Hughes and / Hephzebah Hughes their executors administrators and assigns that he the said George Ebenezer Knight the Younger his heirs executors or administrators shall and will during the continuance / of this Security from time to time when and so often as any or either of the lives in the said hereinbefore recited Grants of the twenty fourth day of October last past or in / any received Grants of the said Copyhold Hereditaments and premises therein comprised and hereinbefore assigned or intended so to be shall determine use his and their / utmost endeavours to procure a renewal of the then subsisting grants of the same premises for two lives in possession and two in reversion Interest for the said Rebecca / Hughes and Hephzebah Hughes their executors adminstrators or assigns according to the custom of the said Manor of Harvington and shall and will pay or cause to be / paid the fines fees costs charges and expenses incidental to every such renewal and also the yearly rents and taxes and heriots when they shall happen payable / in respect of the said Copyhold or such proportionate part thereof as under the said hereinbefore recited Agreements respectively are to be borne and paid in respect / of the Copyhold Premises hereby respectively assigned or intended to take And that if the said George Ebenezer Knight the Younger his heirs executors administrators / or assigns shall neglect or refuse to obtain such renewals and to pay the fines fees and expences incident thereto and the yearly rents and taxes and heriots / or such proportionate part thereof as aforesaid then and so often as it shall so happen It shall be lawfull for the said Rebecca Hughes and Hephzebah Hughes / or the survivor of them or the executor or administrator of such survivor or their or her assigns to obtain such renewals and to pay the fines fees and charges insidental / thereto and also the yearly rents and taxes and heriots or so much thereof as may be payable in respect of the said Copyhold Premises hereby assigned or intended / so to be And that all the hereditaments and Premises hereby conveyed and assigned shall remain and be a Security to the said Rebecca Hughes and Hephzebah / Hughes and the survivor of them and the executors or administrators of such survivor or their or her assigns as well for the payment of all such sums of money as / shall be paid by them or her with Interest for the same after the rate aforesaid from the time of their or her paying the same respectively as for the payment / of the said Principal sum of Four hundred and fifty Pounds and the Interest thereof and be reverable in like manner under the powers and provisions / herein contained And the said George Ebenezer Knight the Younger doth hereby for himself his heirs executors and administrators further covenant and agree / with the said Rebecca Hughes and Hephzebah Hughes their heirs executors administrator and assigns that they the said George Hatton and Ann his Wife / and George Ebenezer Knight the Younger or some or one of them now have or hath in himself or herself good right and absolute authority to grant convey and assure the said Freehold / Messuages and hereditaments intended to be hereby granted and conveyed with the appurtenances and the fee simple free from all incumbrances To the uses and in / manner aforesaid according to the true intent of these presents And also that they the said George Ebenezer Knight the Younger and Hannah Knight now have in / themselves good right and absolute authority to assign and assure the said Copyhold Premises firstly hereinbefore assigned with the appurtenances free from all incumbrances / unto the said Rebecca Hughes and Hephzebah Hughes their executors administrators and assigns for the lives and life of the said George Ebenezer Knight the Elder Hannah / Knight and George Ebenezer Knight the Younger and the survivors and survivor of them in manner aforesaid and according to the true intent of these Presents And also that / he the said George Ebenezer Knight the Younger now hath in himself good right and absolute authority to grant and assign the Copyhold Premises secondly hereinbefore / assigned free from all incumbrances unto the said Rebecca Hughes and Hephzebah Hughes their executors administraters and assigns in manner aforesaid and according to / the true intent of these presents And moreover that if Default shall be made in payment of the said sum of Four hundred and fifty Pounds or the Interest thereof contrary to the aforesaid covenant for / payment of the same respectively It shall be lawfull for the said Rebecca Hughes and Hephzebah Hughes their heirs executors administrators and assigns respectively at any time or times / thereafter into and upon all the said Freehold and Copyhold Hereditaments and Premises to enter and the same from time to time peacefully to possess and enjoy and receive and take the rents / and profits thereof respectively And also to receive and take the said Policies monies and Premises for their own use and benefit respectively without any interruption whatsoever / and that free and clear and by the said George Ebenezer Knight the Younger his heirs executors or administrators indemnified from and against all Estates titles troubles changes / debts and incumbrances whatsoever And moreover that he the said George Ebenezer Knight the Younger his heirs executors or administrators and all persons whomsoever claiming any Estate or / Interest in the said Hereditaments and Premises hereby conveyed as aforesaid or intended so to be or any part thereof respectively shall And will at all times hereafter at the request of the said / Rebecca Hughes and Hephzebah Hughes their heirs executors administrators or assigns or any of them but at the costs and charges of the said George Ebenezer Knight the Younger his heirs / executors or administrators make and execute or procure to be made and executed all further assurances whatsoever that may be necessary for the more affectually assuring the said / Freehold Hereditaments intended to be hereby conveyed unto and to the use of the said Rebecca Hughes and Hephzebah Hughes their heirs and assigns and for assigning and assuring / the said Copyhold Premises and policies of assurance and monies and premises hereby respectively assigned or intended so to be unto the said Rebecca Hughes and Hephzebah Hughes / their executors administrators and assigns in manner aforesaid according to the true intent of these presents and for enabling and empowering the said Rebecca Hughes and Hephzebah

Hughes or the survivor of them or the executors or administrators of such survivor or their or her assigns to recover and receive the monies / secured by the said Policies or either of them as by the said Rebecca Hughes and Hephzebah Hughes their heirs executors administrators and assigns or either / of them or their and either of their Councel shall be reseasonably advised Provided always and it is hereby expressly declared that the total amount of principal money / intended to be hereby secured shall not exceed the sum of Five hundred Pounds And also that if during the continuance of this security either of them the said Rebecca / Hughes and Hephzebah Hughes shall die the receipt and receipts in writing of the survivor of them or the executors administrators or assigns of such survivor for the / Principal mnoney and Interest then remaining owing upon the present security or any part thereof respectively or for the monies to become payable in respect of the said / policies of assurance or either of them shall effectually discharge the person or persons respectively paying the same from the money therein acknowledged to be received and from being / accountable for any loss misapplication non application thereof or from being obliged to see to the application thereof And further that upon the payment of such principal monies / and Interest the Survivor of them the said Rebecca Hughes and Hephzebah Hughes and the heirs executors administrators and assigns such survivor shall be fully competent / to reconvey and reassign the said hereditaments and Premises respectively discharged from any lien or claim of the executors administrators or assigns of such deceased / Mortgage any rule of law or equity to the contrary thereof notwithstanding Provided also and it is hereby further declared that if default shall be made in payment of the said sum of Four hundred and / fifty Pounds or the Interest thereof or any part thereof in manner aforesaid and the said Rebecca Hughes and Hephzebah Hughes or the survivor of them or the executors of the administrators of such / Survivor of their or her assigns shall at any time afterwards give to the said George Ebenezer Knight the Younger his heirs executors administrators or assigns or leave at his or their usual last known / place of abode in England notice in writing of an intention to exercise this power of Sale then unless the said sum of Four hundred and fifty Pounds with all Interest due thereon and all costs occasioned / by the nonpayment thereof and all other the principal monies and Interest then due by virtue of these presents shall be paid as the end of Four Calendar months from the giving or leaving such / notice or otherwise at any time when and so often as the interest of any preceding half year payable under these presents shall be unpaid by the space of two months after the same / ought to have been paid then and in either of such cases it shall be lawful for the said Rebecca Hughes and Hephzebah Hughes or the Survivor of them or the executors or administrators / of such Survivor or their or her assigns at any time after the experation of the said Four Calendar months without the necessity of the concurrance or consent of the said George / Ebenezer Knight the Younger his heirs executors administrators or assigns or of the said Hannah Knight absolutely to sell and dispose of all the said hereditamtnets policies and Premises / hereby respectively conveyed and assured or intended so to be or any part thereof respectively together or in parcels by public auction or private contract and subject or not subject to any / special or other conditions relative to the title or the evidence of Title or otherwise shall appear expedient and with full power to purchase in the said hereditaments policies and / Premises or any of them or any part thereof at any auction and also to rescind or vary the terms of any contract for sale and to receive the money to arise from the sale or sales thereof / and out of the same money in the first place to pay or reimburse themselves or herself the costs and expences of such sale or sales or anyway incidental thereto and in the next / place to retain and satisfy the said sum of Four hundred and fifty Pounds and all other monies if any then owing by virtue of these presents with all interest due for the / same respectively and all costs and expences occasioned by the nonpayment therof And lastly to pay the surplus (if any) of the money so to arise as aforesaid to the said / George Ebenezer Knight the Younger his heirs executor administrators or assigns And the said George Ebenezer Knight and Hannah Knight hereby expressly declare / that every receipt which shall be given by the said Rebecca Hughes and Hephzebah Hughes or the Survivor of them or the executors or administrators of such Survivor or / their or her assigns to any purchase or purchases under the Power of the hereinbefore contained for his her or their purchase money shall exonerate such purchasere or purchasers / from all liability in respect of the application thereof And that such purchaser or purchasers shall not be obliged to enquire or take notice whether any sale or sales is or / are necessary or proper nor whether any such default has been made or notice given as aforesaid nor be affected by express knowledge of any unregitarity in the exercise of the / said Power of Sale Provided also that the said Rebecca Hughes and Hephzebah Hughes their heirs executors administrators or assigns respectively shall not be liable / or accountable for any involuntary losses and shall notwithstanding the Power of Sale hereinbefore contained and concurrently therewith have all the rights and remidies by / foreclosure or otherwise of a Mortgage in ordinary cases And that the Power of Sale and of giving receipts and other powers hereinbefore contained shall and may be effectually exercised by the / assign or assigns of the said Rebecca Hughes and Hephzebah Hughes or the survivor of them her executors administrators any rule of Law or Equity to the contrary notwithstanding / And the said George Ebenezer knight hereby lastly declares that after default as aforesaid it shall by lawful for but not obligatory upon the said Rebecca Hughes and Hephzebah / Hughes or the Survivor of them or the executors or administrators of such Survivor or their or her assigns or in the name or names of the said George Ebenezer Knight the / Younger his heirs executors administrators or assigns to demand and receive from all the present and future occupiers of the freehold and Copyhold Hereditaments and premises / All the rents and profits now or hereafter to become due in respect thereof and in default of payment to use and procure all such remedies by action distress entry or otherwise / and generally to do all such other acts as shall be expedient for the receiving and recovering of the said rents and profits and to apply the same in discharging all taxes / rates and outgoings and all reasonable expences attending the receipt and recovery of the said rents and profits and in payment of the Interest which shall from time / to time be payable in respect of the said principal sum of Four hundred and fifty Pounds and all other the principal money for the time being due upon / this security as often as any half yearly portion thereof shall be in arrear and unpaid and particularly in paying when and as the same shall become payable / the said several yearly premiums and duty payable in respect of the said Policies of Assurance hereby respectively assigned and the Insurance from fire so as / to keep the same respectively on foot with liberty to apply the surplus of the said rents and profits in payment of the principal money of the time being due / upon the present security. These are to Certify that on the thirtieth day of April in the year One Thousand Eight Hundred and Fifty eight before us Henry Workman and Courtenay Connell Prance, Two of the perpetual Commissioners appointed for the County of Worcester for taking the acknowledgments of Deeds by Married Women, pursuant to an Act passed on the Third and Fourth Years of the Reign of His late Majesty King William the Fourth intitled "An Act for the Abolition of Fines and Recoveries, and for the substitution of more simple modes of Assurance," appeared personally Hephzebah the wife of Benjamin Luxton and produced a certain Indenture marked a/3 bearing date the eighth day of March One thousand eight hundred and fifty eight and made between Benjamin Luxton and Hephzebah his wife of the one part and Anthony Martin of the other part and acknowledged the same to be her Act and Deed AND WE DO HEREBY CERTIFY that the said Hephzebah Luxton was at the time of her acknowledging the said Deed of full age and competent understanding, and that she was examined by us apart from her Husband touching her knowledge of the contents of the said Deed and that she freely and voluntarily consented to the same.

This Indenture made the eighth day of March One thousand eight hundred and fifty eight Between Benjamin Luxton / of Evesham in the County of Worcester Farmer and Hephzebah his Wife heretofore the within named Hephzebah Hughes Spinster of / the one part and Anthony Martin of Evesham in the County of Worcester Surgeon of the other part Whereas at a Court / Baron of the within named Dean and Chaptor of the Cathedral Church of Christ and the Blessed Mary the Virgin of Worcester holden for / the within named Manor of Harvington on the twenty fifth day of October One thousand eight hundred and fifty four the within mentioned One Messuage and half yard land with the appurtenances / together with the Messuages tenements and other buildings which had been erected and built upon part of the said premises were granted to Samuel Stone Charles and Henry Sheaf In trust as to part of the / premises being the within described piece of land containing Two thousand four hundred and twenty square yards and Six hundred and ten square yards respectively together with the Messuages erected in / thereon for the within named Rebecca Hughes and the said Hephzebah Luxton their executors This Indenture made the seventh day of January in the year of our Lord one thousand eight hundred and seventy eight Between Albert William Byrch of Evesham in the / County of Worcester Gentleman Thomas Cox of the same place Gentleman and Edmund Douglas Lowe of the same place Draper of the first part William Grove of the / Greenhill in Evesham aforesaid Gardener of the second part John Cook of the Parish of Harvington in the County of Worcester Inn Keeper of the third part and Elizabeth Mary / Stephens of the said Parish of Harvington Spinster of the fourth part and the said Elizabeth Mary Stephens of the fifth part Whereas by an Indenture dated the thirtieth day / of September one thousand eight hundred and sixty nine and made between the said William Grove of the one part and John Stephens Gentleman of the other part in consideration of the sum of / One hundred pounds to the said William Grove paid by the said John Stephens the hereditaments intended to be hereby assured with their appurtenances were (inter alia) granted by the said William / Grove unto and to the use of the said John Stephens his heirs and assigns subject nevertheless to the proviso therein contained for the redemption of the said hereditaments on payment by the said / William Grove his heirs executors or administrators unto the said John Stephens his executors administrators or assigns of the sum of One hundred pounds together with interest thereon on the thirtieth day of March then next And whereas by an Intenture / dated the third day of February one thousand eight hundred and seventy and made between the said William Grove of the one part and the said John Stephens of the other part in consideration of the further sum of One hundred pounds to the said William Grove / paid by the said John Stephens the hereditaments intended to be hereby assured where (inter alia) made chargeable with and remain a security for the payment by the said William Grove his heirs executors or administrators to the said John Stephens his executors adminstrators / or assigns of as well the sum of One hundred pounds and the interest thereof secured by the last recited Indenture as of the sum of One hundred pounds then advanced and the interest for the same according to the covenant in the now reciting Indenture contained for payment / thereof And whereas by an Indenture dated the twenty sixth day of October one thousand eight hundred and and seventy and made between the said William Grove of the one part and John Stephens of the other part in consideration of the further sum of Sixty / pounds to the said William Grove paid by the said John Stephens the hereditaments intended to be hereby assured were (inter alia) made chargeable with and remain a security for the payment by the said William Grove his heirs executors or administrators to the said John / Stephens his executors administrators or assigns as well as the said two several sums of One hundred pounds and One hundred pounds respectively secured by the hereinbefore recited Indenture of Mortgage and Further Charge and the interests thereof respectively as of the said sum of sixty pounds then advanced and the interest thereof according to the covenants / in the now reciting Indenture contained for payment thereof And whereas by an Indenture dated the eighth day of February one thousand eight hundred and and seventy one and made between the said William Grove of the one part and John Stephens of / the other part in consideration of the further sum of Fifty pounds to the said William Grove paid by the said John Stephens the hereditaments intended to be hereby assured were (inter alia) made chargeable with and remain a security for the payment by the said William Grove / his heirs executors or administrators to the said John Stephens his executors administrators or assigns as well of the said three several sums One hundred pounds One hundred pounds and sixty pounds respectively secured by the hereinbefore recited Indentures of Mortgage / and Further Charges and the interests thereby respectively as of the said sum of Fifty pounds then advanced and the interest thereby according to the covenant contained in the now reciting Indenture for payment thereof And whereas the said John Stephens / departed this life on or about the first day of June one thousand eight hundred and seventy seven having first duly made and executed his last Will and Testament bearing date the fifth day of April one thousand eight hundred and seventy six whereby he appointed the / said Albert William Byrch Thomas Cox and Edmund Douglas Lowe executors and Trusties of his said Will and devised and bequeathed all Estates vested in him as Trustee or Mortgagee unto the said Albert William Byrch Thomas Cox and Edmund Douglas Lowe their / heirs executors and administrators subject to the trusts and equities affecting the same respectively but so that the money secured by such Mortgages should form part of his personal Estate and the said Will was on the first day of August one thousand eight hundred and seventy seven / proved by all the said Executors in the District Registry of the Probate Division of Her Majesty's High Court of Justice at Worcester And whereas the said William Grove has contracted and agreed with the said John Cook for the absolute sale to him of the hereditaments / hereinafter described and intended to be hereby assured with the appurtenances and the inheritance thereof in fee simple in possession free from incumbrances at or for the price or sum of Two hundred and firty five pounds And whereas the said John Cook hath / applied to the said Elizabeth Mary Stephens to lend him the sum of One hundred and Fifty pounds towards the said purchase money which the said Elizabeth Mary Stephens hath agreed to do on having the repayment thereof with interest secured to her in manner hereinafter / expressed And whereas the sum of Two hundred and forty five pounds part of the said principal sum of Three hundred and Ten pounds so due and owing as aforesaid on the said hereinbefore recited Indenture of Mortgage and further charge has been paid off / leaving the sum of Sixty five pounds only now remaining due and owing on the same security and it hath been arranged by and between the said parties hereto of the first and second parts respectively that the said sum of Sixty five pounds shall be paid out of the said / purchase money to the said Albert William Byrch Thomas Cox and Edmund Douglas Lowe who have agreed to join in these presents for the purpose of conveying the hereditaments intended to be hereby assured freed and absolutely discharged from all Mortgage monies and / iterest due on the security of the same and in manner hereinafter appearing Now this Intendure Witnesseth that in pursuance of the said Agreement and in consideration of the sum of Sixty five pounds sterling on or before the execution of these presents to the / said Albert William Byrch Thomas Cox and Edmund Douglas Lowe paid by the said Elizabeth Mary Stephens by the direction of the said William Grove and at the instance and request and for the use of the said John Cook the receipt whereof the said Albert William / Byrch Thomas Cox and Edmund Douglas Lowe both hereby acknowledge and declare the sum to be in full satisfaction and discharge of all principal monies and interest now due on the hereinbefore recited securities or any of them and from the same doth hereby release and / discharge as well the said ELizabeth Mary Stephens her heirs executors and administrators as also the said William Grove his heirs executors administrators and assigns And also in consideration of the sum of Eighty five pounds sterling by the said Elizabeth / Mary Stephens at the like request of the said John Cook and of the sum of Ninety five pounds sterling by the said John Cook severally in hand paid to the said William Grove at or before the execution hereof the payment and / receipt of which said several sums of Sixty five pounds Eighty five pounds and Ninety five pounds (making in the whole the sum of Two hundred and forty five pounds) he the said William Grove doth hereby acknowledge / and from the same doth hereby release and discharge the said Elizabeth Mary Stephens and the said John Cook respectively and their respective heirs executors administrators and assigns They the said Albert William Byrch Thomas / Cox and Edmund Douglas Lowe by the direction of the said William Grove do hereby grant convey and release and the said William Grove doth hereby grant convey and confirm unto the said Elizabeth Mary Stephens and her heirs / All that piece or parcel of land or ground being part of a larger piece of land called 'Squires Ground' situate being and lying in the parish of Harvington in the County of Worcester now or late in the occupation of William Emeny as / Tenant thereof having a frontage of Four hundred and eighty five yards to the road leading from the Village of Harvington into the Road late the Turnpike road leading from Evesham to Alcester and containing by recent / admeasurement one acre two roods and seven perches and is bounded by the said first mentioned road by Cottages and premises belonging to [blank] by lands of the Reverend Arthur Henry Winnington / Ingram and by the other part of the said piece of land called 'Squires Ground' by an Indenture bearing even date herewith conveyed to the said Elizabeth Mary Stephens which said piece or parcel of land hereby conveyed / or intended so to be is thereof drawn in the Margin of these presents and thereon coloured Pink Together with all and singular houses outhouses edifices mines minerals trees woods / mounds fences hedges ditches ways paths passages waters watercourses liberties privileges easements rights members and appurtenances whatsoever to the said piece or parcel of land belonging or in anywise appertaining or to or with the / same now or at any time heretobefore held or enjoyed or taken or known as part parcel or member thereof or appurtenant thereto And all the Estate right title interest inheritance benefit claim or demand whatsoever both at law / and in Equity of them the said parties hereto of the first and second parts and of each of them unto or out of the said hereditaments and premises and every part thereof To have and to hold the said hereditaments and premises / hereby assured or expressed so to be with their appurtenances unto and to the use of the said Elizabeth Mary Stephens her heirs and assigns for ever absolutely descharged from the said Mortgage debt of Three hundred and Ten pounds and every / part thereof and all interest for the same and all claims and demands on account thereof but subject nevertheless to the proviso for redemption hereinafter contained And the said John Cook doth hereby declare that no Widow he may have / at his decease shall be entitled to dower out of or in the said hereditaments and premises or any part thereof And each of them the said Albert William Byrch Thomas Cox and Edmund Douglas Lowe as to his own acts and deeds only / doth hereby for himself his heirs executors or administrators covenant with the said Elizabeth Mary Stephens her heirs and assigns and also as a separate covenant with the said John Cook his heirs and assigns That they the said Albert / William Byrch Thomas Cox and Edmund Douglas Lowe respectively have not at any time donme or executed or knowingly suffered or been party or privy to any act thing whereby the hereditaments and premises hereby assured or / expressed so to be or any of them or any part thereof are is can or may be incumbered And the said William Grove doth hereby of himself his heirs executors and administrators covenant with the said Elizabeth mary Stephens her / heirs and assigns and also as a separate covenant with the said John Cook his heirs and assigns That notwithstanding any act deed matter or thing whatsoever by him the said William Grove or anyone claiming by through or under him / done or executed or Knowingly suffered to the contrary the said Albert William Byrch Thomas Cox and Edmund Douglas Lowe and the said William Grove respectively now have good right to assure the said hereditaments and premises hereby assured or expressed so to be / unto and to the use of the said Elizabeth Mary Stephens her heirs and assigns in manner aforesaid according to the purpose and true intent and meaning of these presents And that the said hereditaments with their appurtenances may at all times hereafter be held and / enjoyed and the rents issues and profits thereof be received and taken under and according to these presents without any lawful interruption claim or demand of from or by the said William Grove or his heirs or any person or persons lawfully or equitably claiming or to claim / by from through under or in trust for him them or any of them And that free and clear and freely and absolutely acquitted exonerated and for ever discharged or otherwise by the said William Grove kept harmless and indemnified of from and against all and all manner of / former and other conveyances assurances Estates troubles liens charges and incumbrances whatsoever heretofore or to be hereafter made done executed committed occasioned permitted or suffered by him the said William Grove or any person or persons whomsoever lawfully claiming or to / claim by from through under or in trust for him them or any or either of them respectively And moreover that the said William Grove and his heirs and all persons claiming or to claim by through under or in trust for him or them shall and will at all times hereafter upon every / reasonable request and at the cost of the said Elizabeth Mary Stephens her heirs or assigns or the said John Cook his heirs or assigns make execute and procure all such further and other lawful and reasonable conveyances and assurances in the Law whatsoever of the said hereditaments

And premises hereby assured with their appurtenances To the use of the said Elizabeth Mary Stephens her heirs and assigns subject as aforesaid or otherwise as shall be reasonably required And the said John Cook doth hereby for / himself his heirs executors and administrators covenant promise and agree to and with the said Elizabeth Mary Stephens her executors administrators and assigns that the said John Cook his heirs executors administrators or assigns some or one of them shall and / will well and truly pay or cause to be paid unto her the said Elizabeth Mary Stephens her executors administrators and assigns the sum of One hundred and fifty pounds of lawful money of Great Britain with interest thereon at and after the rate of Four pounds and ten / shillings per centum per annum computed from the day of the date of these presents at the times and in manner following that is to say the said sum of One hundred and fifty pounds on the seventh day of January which will be in the year of our / Lord one thousand eight hundred and seventy nine and the interest thereof by equel half yearly payments on the seventh day of July and the seventh day of January in the meantime without any deduction or abatement whatsoever except for / income tax and shall and will also pay unto the said Elizabeth Mary Stephens her executors administrators or assigns interest after the rate aforesaid on the said sum of One hundred and fifty pounds or so much thereof as shall remain unpaid by equel half / yearly payments on the days aforesaid in each and every year thereafter so long as the said principal sum or any part thereof shall remain unpaid but this present covenant is in nowise to prejudice the absolute covenant for payment of the said principal sum and / interest firstly hereinbefore contained Provided always and it is hereby declared and agreed that if the said John Cook his heirs executors administrators or assigns shall pay unto the said Elizabeth Mary Stephens her executors administrators or assigns the said / sum of One hundred and fifty pounds with interest thereon at and after the rate at the times and in manner hereinbefore mentioned and appointed for payment thereof according to the covenant hereinbefore contained then the said Elizabeth Mary Stephens her heirs / or assigns shall at any time thereafter at the request and cost of the said John Cook his heirs or assigns convey the said hereditaments and premises hereinbefore granted and conveyed with their appurtenances unto and to the use of the said John Cook his heirs and / assigns or as he or they shall direct But in case default be made in payment of the said sum or the interest thereof in manner aforesaid Then it is hereby declared and agreed that it shall be lawful for the said Elizabeth Mary Stephens her heirs and assigns at any time or times thereafter absolutely to sell and dispose of by Public Auction or Private contract or partly by both the said hereditaments and premises hereby granted and conveyed or any part thereof and the fee simple and inheritance thereof / and with full power for her and them to sell the said hereditaments and premises subject to special or other conditions and restrictions as to nonproduction of Title or otherwise howsoever as he or they may think proper and to fix any reserved biddings and to buy / in all or any of the said hereditaments and rescind and vary any contracts for sale and to resell the said hereditaments in manner aforesaid with the like powers aforesaid without being liable for any loss by any such resale and to receive and take the purchase monies / for the said hereditaments And it is hereby declared and agreed that the said Elizabeth Mary Stephens her heirs executors administrators and assigns shall with and out of the monies to arise by such sale of the hereditaments retain pay / and discharge all costs charges and expences of and incident to such sale or sales or otherwise relative to the premises And in the next place retain and pay to her her executors administrators or assigns the said principal sum and interest hereby / secured and in case there be any surplus of the said monies after the payments aforesaid shall pay the same to the said John Cook his heirs or assigns And it is hereby declared and agreed that all contracts and assurances made or executed / in execution of the power of Sale aforesaid shall be valid and effectial without any further or other parity or concurrance of the said John Cook his heirs executors or administrators or any other person whomsoever and that the receipt and receipts of / the said Elizabeth Mary Stephens her heirs executors administrators or assigns shall be good discharges to all purchasers of the said hereditaments and premises and to all other persons for all purchase money of the said hereditaments And shall discharge / such purchases and others from seeing to the application thereof and from all loss misapplication or nonapplication thereof And that no purchaser or other person shall be bound to inquire whether the said principal sum and interest actually remain / due of otherwise to see the necessity for or propriety of any sale or other act or thing done in pursuance hereof or purporting so to be Provided also and it is hereby declared that notwithstanding the aforesaid Power of Sale or other provisions of these presents / the said Elizabeth Mary Stephens her heirs executors administrators and assigns shall be entitled to the same rights of foreclosure of the said hereditaments and all other rights and remedies on default in payment of the said sum and interest as if the said powers / and provisions were not herein inserted And the said John Cook doth hereby for himself his heirs executors and administrators covenant promise and agree to and with the said Elizabeth Mary Stephens her heirs executors administrators and assigns That / the hereditaments and premises hereby conveyed shall and lawfully may be peacably and quietly had held and enjoyed and the rents and profits thereof be had received and taken according to these presents without any interruption of or by the said John Cook / or his heirs executors or administrators or any other person And that free and clear or by the said John Cook his heirs executors or administraors indemnified from and against all former and other conveyances estates titles troubles liens charges and incumbrances / whatsoever And moreover that he the said John Cook and his heirs and all persons having a lawfully or equitably claiming or to claim any Estate right or interest in the said hereditaments shall and will at all times upon reasonable request of the said / Elizabeth Mary Stephens her executors administrators or assigns but at the cost of the said John Cook his heirs executors or administrators until these premises by sold and disposed of under the powers herein contained or the principal monies and interest / hereby secured be paid and discharged and afterwards at the costs of the person or persons requiring the same make and execute all such further and other lawful and reasonable conveyances and assurances of the said hereditaments for the purposes of these / presents as shall be reasonably required And lastly it is hereby declared and agreed that until default be made in payment of the aforesaid principal money or interest it shall be lawful for the said John Cook his heirs and assigns to hold and enjoy / the said hereditaments hereby conveyed and recure and take the rents and profits thereof without any incumbrance of the said Elizabeth Mary Stephens her heirs or assigns And whereas by the said before mentioned Indenture of even date herewith / made between the said Albert William Byrch Thomas Cox and Edmund Douglas Lowe of the first part the said William Grove of the second part and the said Elizabeth Mary Stephens of the third part for the considerations therein mentioned a piece / or parcel of Land and hereditaments adjoining the hereditaments hereby conveyed or expressed so to be and being part of 'Squires Ground' before mentioned was conveyed and assured unto and to the use of the said Elizabeth Mary Stephens her heirs and assigns / for ever freed and discharged from all Mortgage incumbrances And whereas the Deeds evidences and writings comprised in the schedule hereto relate not only to the hereditaments hereby assured or expressed so to be but also to the hereditaments comprised / in the said recited Indenture of even date herewith and the same by agreement have been delivered to the said Elizabeth Mary Stephens who has agreed to enter into such covenants in respect thereof as are hereinafter contained Now this Indenture further / witnesseth that in pursuance of the said Agreement and in consideration of the premises she the said Elizabeth Mary Stephens for herself her heirs executors and administrators doth hereby covenant with the said John Cook his hearing commission or examination in any court of Judicature or to any arbitator or umpire or otherwise as occasion shall require for the manifestation / defence or support of the Estate title or possession of the said John Cook his heirs or assigns to the hereditaments and promises hereinafter conveyed and assured or expressed or intended so to be or any part thereof All and every or any of the deeds instruments evidences / or other writings specified in the schedule hereunder written And at the like request make and deliver or cause to be made and delivered true and attested or true unattested copies or abstracts of the same deeds instruments evidences or writings or any of them respectively / and permit and suffer such copies or abstracts to be examined and compaired with the said writings by the said John Cook his heirs or assigns by such person or persons as he or they shall from time to time desire in that behalf And shall and / will at all times hereafter take due and proper care to preserve the same deeds instruments evidences or other writings from being defaced injured cancelled lost or destroyed In witness whereof the said parties to these presents have In the matter of the Title to four messuages and hereditaments situate at Harvington in the County of Worcester in the occupation of Eli Smith, H Newman, T Fowler and W Eden

I George Henry Garrard of Evesham in the County of Worcester do solemnly and sincerely declare as follows:-
1. That I was a member of the late firm of New, Prance and Garrard Solicitors, Evesham from its commencement in the year one thousand eight hundred and fifty four up to the date of the adjudication in Bankruptcy on the twenty second day of June one thousand eight hundred and ninety four. I know and am well acquainted with the above mentioned Harvington property the same was purchased by my late firm out of partnership moneys on the eighth day of March one thousand

eight hundred and fifty eight since which date and up to the date of our Bankruptcy my late firm have been in the free and undisturbed possession and enjoyment or receipt of the rents and profits of the said property and have always paid all necessary repairs and other outgoings not payable by the actual tenants of the said property and have always to the best of my knowledge information and belief throughout the above named period of 36 years acted as the legal owners of such property without any interference or question from any person or persons.

And I make this Solemn Declaration conscientiously believing the same to be true and by virtue of the Solemn Declarations Act 1835.

This Indenture made the ninth / day of January one / thousand eight hundred / and ninety five / Between Arthur James West of 22 Waterloo Street in the City of / Birmingham of the one part and James William Wagstaff of / Fladbury in the County of Worcester Gentleman of the other part / Whereas at the date of the Memorandum hereinafter recited / Herbert New Courtenay Connell Prance and George Henry Garrard / who were then carrying on business as Solicitors at Evesham in the / said County of Worcester under the style or firm of New Prance and / Garrard were seized of the hereditaments mentioned in the first Schedule / thereto and intended to be hereby assured for an estate in fee simple / and were seized of the hereditaments mentioned in the second Schedule / thereto for the life only of George Ebenezer Knight who is still alive being / of the age of about [blank] years and who now resides at / [blank] in the County of [blank] And whereas by a Memorandum / dated the twenty ninth day of November one thousand eight hundred / and eighty six under the hands of the said New Prance and Garrard / the said Herbert New Courtenay Connell Prance and George Henry / Garrard thereinafter called Messieurs New Prance and Garrard did / admit and acknowledge that they had in their hands for investment / the sum of Six hundred and fifty Pounds belonging to the said James / William Wagstaff and that they had deposited with the said James William / Wagstaff the Title Deeds relating to eight cottages or tenements and hereditaments situate at / Harvington in the said County of Worcester (being the hereditaments intended to be hereby assured) to secure the repayment by them unto the said / James William Wagstaff of the said sum of Six hundred and fifty Pounds / and interest thereon at Four pounds and ten shillings per centum / per annum on the twenty ninth day of May then next And the said Messieurs / New Prance and Garrard did thereby charge and make chargeable the said / cottages or tenements and hereditaments with the payment by them to the / said James William Wagstaff of the said sum of six hundred and fifty / Pounds and of the interest thereon after the rate aforesaid And the said / Messieurs New Prance and Garrard did thereby guarantee the sufficiency / of the said security and the due and regular payment to the said James / William Wagstaff half yearly from the date thereof of interest thereon after / the rate aforesaid And also the repayment to the said James William / Wagstaff of the said sum of Six hundred and fifty Pounds or any part / thereof with interest at any time upon receiving six months previous / Notice from the said James William Wagstaff desiring payment of the same / And whereas the said Herbert New died on the twenty eighth day of / November one thousand eight hundred and ninety three leaving the said / Courtenay Connell Prance and George Henry Garrard him surviving / And whereas the said Courtenay Connell Prance and George Henry / Garrard were adjudicated Bankrupts by an Order of the County Court / of Worcestershire holden at Worcester dated the twenty second day of June / one thousand eight hundred and ninety four upon a petition of Bank- / ruptcy filed in such Court and at a meeting of the creditors on the same / date the said Arthur James West was by a resolution of the said

Creditors duly appointed Trustees of the property of the said Bankrupts / and such appointment was duly certified by a Certificate of the / Board of Trade dated the twenty fifth day of June one thousand / eight hundred and ninety four And whereas by an order of / the Chancery Division of the High Court of Justice made by / Mr. Justice Stirling on the tenth day of April one thousand eight / hundred and ninety four in the matter of the estate of the / said Herbert New deceased in an Action instituted by his executors / it was ordered that the estate of the said Herbert New deceased / should be administered under the direction of the Court And / by another Order made by Mr. Justice Stirling in the same matter / and Action on the twenty eighth day of July one thousand eight / hundred and ninety four it was ordered that the said Action be / transferred to the County Court of Worcestershire holden at Worcester / being the Court having Bankruptcy jurisdiction for the District in / which the said deceased resided or carried on business for the / greater part of the six months immediately prior to his decease / And whereas at a meeting of the creditors of the said Herbert / New deceased held at the office of the official Receiver in Bankruptcy / at Worcester on the twenty third day of October one thousand / eight hundred and ninety four the said Arthur James West was / by a resolution of the creditors duly appointed Trustee of the property / of the said Herbert New deceased and such appointing was / duly certified be a Certificate of the Board of Trade dated the / thirtieth day of October one thousand eight hundred and ninety / four And whereas at the date of the said bankruptcy the / said firm of New Prance and Garrard was and still is / indebted to the said James William Wagstaff in the sum of / six hundred and fifty Pounds in respect of the hereinbefore / recited memorandum And whereas it has been agreed between / the parties hereto that the said James William Wagstaff shall / accept such a Conveyance as is hereinafter contained in full discharge / of his said debt of six hundred and fifty Pounds and / the said James William Wagstaff has agreed to accept such conveyance / in satisfaction of such security as aforesaid and also to give up / any claim he may have against the estate of the said Bankrupts / as far as the above recited security of six hundred and fifty Pounds / is concerned Now this Indenture witnesseth that in pursuance / of such Agreement and in consideration of the said debt of six / hundred and fifty Pounds so owing by the said firm of New Prance / and Garrard to the said James William Wagstaff as aforesaid from / the payment whereof and from all claims and demands in respect / whereof the said James William Wagstaff doth hereby release the / said Arthur James West and the joint estate of the said firm of / New Prance and Garrard and the separate estates of each of the / partners in the said firm the said Arthur James West as trustee hereby / conveys Firstly All those the hereditaments and premises comprised in / the first Schedule hereunder Written To hold the same unto and to / the use of the said James William Wagstaff in fee simple and Secondly / All those the hereditaments and premises comprised in the second

[Side one:] An Agreement made this eighth day of / Febraury One thousand nine / hundred and one Between The Estates Committee of / The Ecclesiastical Commissioners for England (hereinafter / referred to as "the Vendors") by Thomas Percy Borrett of No 6 / Whitehall Place in the City of Westminster Gentleman their / Agent of the one part and James William Wagstaff of / Fladbury in the County of Worcester (hereinafter / referred to as "the Purchaser") of the other part Whereas / on the twenty fifth day of October One thousand eight hundred / and fifty four a certain piece of land containing Two roods / and twenty two perches on which eight cottages are now / standing and which said piece of land is parcel of the / Manor of Harvington in the County of Worcester and is / delineated on the plan hereto annexed and is on such / plan colored[sic] red and is now held by the Purchaser or / his undertenants was with other hereditaments also parcel / of the said Manor granted by Copy of Court Roll by the / then Lords of the said Manor according to the custom / thereof for the lives and life of four persons thereof / named of whom Samuel Sheaf is now the sole survivor / and the lives and life of the survivors and survivor / of such four persons And whereas the Manor of Harvington / aforesaid and the reversion and freehold in the said piece / of land subject to the said grant and now claimed by / the said Vendors to be vested in them Now it is / hereby agreed as follows:

  1. The Vendors will sell and the Purchaser will purchase / for the price of Two hundred and fifteen pounds to / be paid as hereinafter mentioned All that the freehold and / reversion of the Vendors expectant on the death of the said / Samuel Sheaf in the said piece of land and hereditaments / colored[sic] red on the said plan.

  2. The said purchase money of Two hundred and fifteen / pounds shall be paid by the Purchaser to the Vendors / immediately upon the death of the said Samuel Sheaf / and shall in the meantime carry interest at the rate of / Three pounds per cent per annum from the twenty fifth [Side two:] day of December One thousand nine hundred to be / considered is accruing de die in diem but to be paid by / equel half yearly payments on the twenty fourth day / of June and the twenty fifth day of December in every year /
  3. Upon payment of the said sum of Two hundred and / fifteeen pounds in manner aforesaid with all arrears (if / any) of interest thereon under the stipulations hereinbefore / contained the Vendors will execute a proper Conveyance of / their freehold and reversion aforesaid in the said piece of / land and premises colored[sic] red on the said plan to the / Purchaser or as he shall in writing direct but such / Conveyance and every other assurance and act if any which / may be required by the Purchaser shall be prepared / made and done by and at the expence of the Purchaser
  4. The Title of the Vendors as Lords of the said Manor of / Harvington to the reversion aforesaid in the said piece / of land and premises is hereby acknowledged and they shall / not be required to furnish any evidence thereof nor of their / power to sell the said premises
  5. Until the completion of the purchase the purchaser / shall insure and keep insured in the Law Fire Office / all the Cottages and buildings on the said piece of land / against loss or damage by fire in the sum of Five / hundred pounds at the least and will duly and punctually / pay all premiums and sums of money necessary for / keeping the said cottages and buildings so insured and / will whenever required by or on behalf of the Vendors / produce and shew to them or their Agent the policy / or policies of such Insurance and the receipt for every / such premium And that in case the said Cottages / buildings or any of them shall at any time before / the said sum of Two hundred and fifteen pounds shall / have been fully paid be destroyed or damaged by fire / then as aften as the same shall happen all moneys / received in respect of such insurance shall forthwith be / laid out in rebuilding repairing or otherwise reinstating / the same premises and in case the moneys received in / respect of the said insurance shall be insufficient for [Side three:] that purchase will make good the deficiency out of the / proper moneys of the purchaser.
  6. The purchaser shall once in every year until the / said sum of Two hundred and fifteen pounds shall be / fully paid produce to the Vendors or their Agent / satisfactory evidence that the said Samuel Sheaf is / still living and if the Purchaser shall at any time make / default in producing such evidence the said Samuel / Sheaf shall for the purchase of this Contract be / deemed to be dead

This Indenture / made the ninteenth day of / June One thousand nine / hundred and nineteen Between / James William Wagstaff of Fladbury in the County of Worcester / Gentleman of the one part and John Cook of Harvington in / the County of Worcester aforesaid Postmaster of the other part / Whereas by an Indenture dated the eighteenth day of / February One thousand nine hundred and four and made / between The Ecclesiastical Commissioners for England of the one / part and the said James William Wagstaff of the other part for / the consideration therein mentioned the hereditaments hereinafter / described and intended to be hereby conveyed were with other / hereditaments conveyed by the Commissioners unto and to the / use of the said James William Wagstaff in fee simple And whereas by an Indenture dated the thirtieth day of September / One thousand nine hundred and eighteen and made between / the said James William Wagstaff of the one part and Arthur / William Fowler of Harvington aforesaid Master Gardener of the / other part for the consideration therein mentioned the Three cottages / and hereditaments therein described being part of the hereditaments / conveyed to the said James William Wagstaff as aforesaid were / conveyed by the said James William Wagstaff unto and to the use of / the said Arthur William Fowler in fee simple subject to the liability / of the said Arthur William Fowler his heirs and assigns or other / the owner or owners for the time being of the hereditaments thereby / conveyed within six calendar months from the date of the Indenture / now in recital jointly with the owner or owners for the time being / of the hereditaments intended to be hereby conveyed to erect and thereafter / to keep in repair or good and sufficient fence or wood or iron of not / less than four feet in height along the boundary line as staked / out and shewn by pegs between the hereditaments thereby conveyed / and the hereditaments intended to be hereby conveyed And whereas / the said James William Wagstaff has agreed to sell the said hereditaments / hereinafter described and intended to be hereby conveyed to the said / John Cook at the price of three hundred and fifteen pounds subject / to the liability to erect and keep in repair the said fence so as as / it effects the said hereditaments Now this Indenture witnesseth / that in pursuance of the said agreement and in consideration of the / sum of Three hundred and fifteen pounds to the said James / William Wagstaff paid by the said John Cook on or before the / execution of these presents (the receipt whereof the said James

William Wagstaff hereby acknowledges) The said James William Wagstaff / as beneficial owner hereby conveys unto the said John Cook All / those Four cottages or tenements with the outbuildings gardens and / premises therein belonging (including the site of a cottage formerly / occupied by W. Spinks but now pulled down) formerly forming part / of the hereditaments conveyed to the said James William Wagstaff by the / firstly hereinbefore recited Indenture of Conveyance situate at Harvington / in the County of Worcester aforesaid formerly in the respective / occupations of William Eden Henry Newman Eli Smith and John / Fowler but now of J. H. Tyack Walter Archer Mrs Mason and Arthur / William Fowler as tenants thereof To hold the same unto and to / the use of the said John Cook in fee simple subject to the liability / to erect and keep in repair the said fence so far as the same affects / the hereditaments hereby conveyed And the John Cook hereby / covenants with the said James William Wagstaff that he the said / John Cook his heirs and assigns will upon the request of the owner / or owners of the said hereditaments conveyed to the said Arthur / William Fowler as aforesaid and jointly with him or them erect / and keep in repair the said fences and will at all times keep the / said James William Wagstaff his heirs executors and administrators / indemnified from and against all claims and demands in respect / thereof And it is hereby certified that the conveyance and transfer / hereby made is a separate transaction and does not form part of a / larger transaction or of a series of transaction in respect of which / the amount or value or the aggregate amount or value of the / consideration exceeds the sum of Five hundred pounds In witness / whereof the said parties to these presents have hereunto set their / hands and seals the day and year first before written.

CONCLUSIONS DRAWN.

Property deeds are complex documents, often written in an archaic and legalistic form, which is convoluting, repetitive and lengthy. It is very difficult for a layman to destinguish the various documents - Conveyances, Mortgages, Indentures, and whether they are dealing with freehold, leasehold or copyhold. It really needs a solicitor to interpret these documents. The following is an attempt to at least clarify or itemise that which appears in the documents.

The above image has been extracted from one of the plans that shews in pink the area to which these deeds relate. In yellow is Village Street while the line running roughly from lower right to upper left shews the line of Green Street. From right to left the plan depicts:-

  1. The little cottage on the corner. This building is not coulered pink on the 1838 plan of the village, which suggests that it was not then a home.
  2. The larger L-shaped building is or was the Hop Pole Inn, now divided into two. The right-hand property is called Hop Pole Cottage.
  3. The next building, its function now known but propbably a barn was demolished at some stage and a modern house stands in its place.
  4. The next and tiny building was 'Spinks' Cottage, a timber framed building demolished in 1919. Bungalows now occupy its position.
  5. The row of four tenements built in the 1840's and demolished in the 1960/70's. Here called 'Post Office Cottages'.

      The above photograph depicts the corner of Cotswold View on the extreme left, with Spinks Cottage in the centre and the Hop Pole complex beyond.

      Here follow some notes taken from the Deeds.
      Blue 1 dated 24 May 1844 & 19 Nov 1849
      Concerning a half yard land (7.5 acre) set within the triangle of Village Street and Green Street. A Mortgage between George Ebenezer Knight and Winifred Maria Fisher.

      24 Oct 1818
      Granted by the Manor to (as tenants) Samuel Stone Charles aged 35 & Edmund Charles in trust for Mary Sheaf of Dorsington.

      Henry Sheaf aged 22 and Charles Sheaf aged 20 as tenants also in trust for Mary Sheaf after the decease of Samuel Stone Charles & Edmund Charles.

      16 Jul 1830
      Then under lease to George Ebenezer Knight.

      Mary Badderley was the owner until she died, Will dated 28-2-1832, proved 15 Aug 1837. She had lately purchased the land from Mary Sheaf. The executors were John Oldaker & John Edwards, both Maltsters of Abbots Salford. A Beneficary was Isabella Knight her niece, then under age, held in trust by George Ebenezer Knight, Gardener & Seedsaman of Bilston, Staffs and Hannah his wife. George Ebenezer Knight their son was Seedsman in Wolverhampton. By this time a messuage and two cottages are on part of the land.

      10 Apr 1840
      An agreement made between Mary Sheaf and George Ebenezer Knight, then in occupation by Richard Squires, was to be sold. This presumably refers to a piece of land called 'Squires Ground' situated on the Alcester Road.

      Indenture date 19 Nov 1840, between Howard William Mansfield Jackson of Hampstead and Winifred Maria his wife.

      24 May 1844
      Winifred Maria Fisher of Childswickham transfers £150 and now possess land once belonging to Mary Badderley.

      Blue 7 dated 3 Nov 1849
      Samuel Stone Charles of Harvington, now aged 60, & Henry Sheaf now aged 53, in possession of part of the land with land adjoining held by Mary Sheaf, Edmund Charles is now deceased. Henry Sheaf and Charles Sheaf were sons of Samuel Sheaf of Dorsington.

      Blue 8 dated 24 Oct 1849
      Indenture made between Howard William Mansfield Jackson of Hampstead, Middlesex, and Winifred Maria his wife late Fisher, and George Ebenezer Knight the Elder and the Younger.

      Charles Sheaf is aged 5, the son of Samuel Sheaf of Dorsington, Yeoman and Henry Sheaf the Younger aged 15, son of Henry Sheaf of Dorsington, Farmer, are named in trust over the same piece of land, again butting on lands belonging to Mary Sheaf. The land is now in the tenure of Samuel Stone Charles.

      Blue 2 dated 28 Feb 1850
      A mortgage of freehold and copyhold premises. George Ebenezer Knight to Rebecca and Hephzebah Hughes of Evesham and a Conveyance from Mr & Mrs Luxton to Anthony Martin dated 8 Mar 1858. George Ebenezer Knight was 'of Harvington' described as a shopkeeper but now a Seedsman in Wolverhampton .

      Presumably one of the properties in which the following were In possession: William Huband then James Jones then his Widow then Moses Jones now apparently George Malin.

      • Part was in possession of George and Ann Hatton from 1829.
      • Part was in possession of William Bullock, Farmer
      Part was in possession of Ann Hatton under the Will of her late father William Hatton and mother Ann Hatton. They had granted and released the freehold of the property to George Ebenezer Knight the Elder of Cottage, Orchard and hereditaments. Ann Hatton died before June 1835. Samuel Amos the Elder was also involved as also John Oldaker, John Edwards and George Ebenezer Knight the Younger.


      Hawkes Piece.

      Property in possession Willliam Huband then James jones then his Widow then Moses Jones between the dwelling House formerly of Joseph Ganderton but now of William Hawkes Marshall on the south and on the north and buildings and barn formerly of Benjamin Evans afterwards of William Hawkes Marshall on the south and extending eastwards to a ground formerly of Thomas Walford but now William Hawkes Marshall.

      28th February 1850
      A Mortgage between George Hatton and Ann his wife, formerly of Bidford but now of Birmingham, and George Ebenezer Knight the Elder formerly of Harvington, Shopkeeper but now of Wolverhampton, Seedsman.

      25th October 1854
      Samuel Stone Charles and Edmund Charles are in possession. Thomas Bennett Tomes of Cleeve Prior, Farmer, John Gibbs of Birmingham, Coal Miner and William Dingley Sheaf of Offenham, Farmer are mentioned as Trustees. Samuel Stone Charles of Harvington, Henry Sheaf and George Ebenezer Knight are still involved.

      1858 First listing of properties. Hop Pole Inn but now converted into four tenements now in or late occupation of James Tarrent , Edward Davis, John Hughes and [blank]. as tenants. And also the messuage or tenement occupied by Thomas Hawkes.

      7th January 1878
      John Cook makes his appearance. Albert William Byrch, Solicitor of Evesham. Edmund Douglas Lowe, Draper of Evesham, William Grove of the Greenhill, Evesham, Gardener, John Cook, of Harvington, Innkeeper, Elizabeth Mary Stephens and John Stephens of Harvington. Thomas Cox, Solicitor of Evesham are involved in the property. On this document (Blue 4.), A plot of land on the Alcester Road is mentioned. It once occupied by Richard Squires and now called 'Squires Ground'. The tenant was William Emeny, the landlord at the Coach and Horses. It belonged to Rev Winnington-Ingram but now conveyed to Elizabeth Mary Stephens. Samuel and George Henry Garrard also involved, they were Solicitors. The family were from the Rectory, Salford Priors.

      9th January 1895.
      George Henry Garrard of Evesham is forced into bankruptcy by the death of Herbert New, Solicitor. He held possession of the four messuages (presumably the terrace of four tenements situate beihnd and to the side of the present Cotswold View. Arthur James West of Birmingham and James William Wagstaff, of Fladbury, Solicitor was buying in. There are 8 messuages cited. The tenants were sited as Eli Smith, Henry Newman, Thomas Fowler and William Eden, occupiers of the terrace of 4 tenements. They were later occupied by Ludlow, Mrs Hughes, Hayward and J Spinks.

      Blue 14 - 18th February 1904
      The tenants of the 4 tenements and the Hop Pole complex were Charles Ludlow, Percy Jones, Ernest Albert Shailer, William Eden, Henry Newman, Eli Smith, John Fowler and W Spinks.

      30th January 1911
      An Conveyance between John Cook and Thomas Cox.

      30th September 1918
      The three cottages were conveyed from James William Wagstaff to Arthur William Folwer.

      19th June 1919
      Concerning 8 meeuages between John Cook and James William Wagstaff. Involved was Arther William Fowler, of Harvington, Master Gardener of the Hop Pole part including Spinks Cottage, described as "now pulled down" and formerly occupied by W. Spinks. It also mentions the terrace of four tenements being occupied by "William Eden Henry Newman Eli Smith and John / Fowler but now of J. H. Tyack Walter Archer Mrs Mason and Arthur / William Fowler as tenants thereof".

HAWKES:-
Thomas Hawkes, born Harvington, aged 57 in 1861. Married Mary A, born Salford, aged 58 in 1861. They has issue:-

  1. Joseph, born Harvington aged 18 in 1861.
  2. Robert, born Harvington aged 15 in 1861.
  3. Henry, born Harvington aged 10 in 1861.
  4. Fred, born Harvington aged 8 in 1861.
  5. James, born Harvington aged 6 in 1861.
  6. Rose E, born Harvington aged 3 in 1861.
SMITH:-
Eli Smith, born Church Lench circa 1840. In 1881 living in Harvington with wife Eliza, daughter Emily and son Ralph C. In 1891 living Harvington with wife and daughter. In 1911 living with wife and daughter in Harvington as a Farm Labourer. He married Eliza, born Lenchwick, aged 67 in 1891. They lived in Post Office Cottages, probably number one, from at least 1895 to 1919. They had issue:-
  1. Emily, born Harvington circa 1877. She married Worcester area 1898 to Reubon Locke, a Carter on farm aged 38 in 1911 born Sutton under Brailes. They had issue:-
    1. Phyllis Victoria, born Harvington 1898.
    2. Ruby Vera, born Harvington circa 1904.
  2. Ralph C, born Harvington circa 1880.
SPINKS:-
James Spink, born Haveningham, Suffolk 1823, died 1905. Married Harriet Collett, 1831-1908. They had issue:-
  1. James Spink, born Gitchill, Salford, Warwickshire 1850. In Harvington by 1861.
  2. Elizabeth, born Salford c1853.
  3. Harriet, born Salford c1855.
  4. Charles, born Salford c1855.
  5. Henry, born Harvington 1861.
